Hi,

Checking if I have any room to get this PCN cancelled.

I parked roughly here at 1349. At the time I parked tightly between two vehicles. No bay markings were visible as they were obscured by the cars on either side. When I returned to my car at 1420, following an alarm alert, I discovered the PCN. By then, the cars beside me had left, which created the misleading appearance that I had ignored the bay markings, which had only then become visible.

Having looked across the row, it was clear that many vehicles had been forced to shuffle up, making it difficult for several drivers to remain within the lines. I personally observed at least three other cars in the same situation, none of which had received PCNs. The CEO shrugged off this which I felt shoed inconsistent application of the rules.

I also spoke politely with the parking attendant, who acknowledged that the parking situation on 23/09 was unusually difficult due to the volume of cars and limited space.

I made an informal challenge based on the text above which was rejected, as many believe is expected:

Thank you for your recent correspondence regarding the above Penalty Charge Notice (PCN). After consideration of the circumstances I regret I have found no grounds for the cancellation of the penalty charge.

The PCN was correctly issued as your vehicle was Code 86 Parked beyond the bay markings.

When your vehicle was inspected it was parked across two bays and under these circumstances our Enforcement Officers are obliged to issue a PCN. Even if other drivers had parked out of a bay or partially over the line then you should not have followed suit, and an alternative bay should have been sought or if the car park was full another car park should have been used. There are signs on this car park to inform the motorist they must park between the white posts.

It is the responsibility of the driver to check the highway regulations at the time of parking. Your reasons are therefore not accepted as grounds for cancellation of the PCN.


I'd be interested to understand whether posts and can be used as bay markings, the signage is adequete or if there are other routes to be taken to get this cancelled.

This looks like a ridiculous PCN - how are you supposed to be aware of the white posts.

And the contravention description is not correct - you were not beyond the bay markings but apparently not within a marked bay.

I'll see if I can dig out the order.

I would appreciate that.

In fact, I’d happily donate the PCN charge to the site upkeep if it can get cancelled.

This is the order and it does specify parking 'wholly within the parking bays where marked at the parking place'.

Where is the sign about the posts and were you aware of this.

In any case I can't see how posts are sufficient and they also allege you were 'beyond the bay markings'.

IMO a correct contravention is 'not parked correctly within the markings of a bay or space' leaving aside whether it's sufficiently marked to be clear.

OP, are you the registered keeper with current DVLA details?

I ask because for the moment your involvement (as driver) is at an end: the next stage is Notice to Owner to the registered keeper.

I am RK with matching DL details at current address.

Interestingly, I made a compliant outside the typical channels and got someone to review the body cam footage where I highlighted to the CEO the other vehicles parked in contravention showing unfair and inconsistent application of the rules. Photographic evidence was provided to show lack of PCNs on any other vehicle to back up my point.

They have since decided to cancel the PCN.
