PCN Code 31 Battersea Bridge Road YBJ

Hi,

I have been served with a PCN Contravention Code 31 Battersea Bridge Road/Battersea Church Road. From the images in the PCN, it is clear I am stationary in the YBJ, however I cannot recall if I did enter while the exit wasn't clear or a car from the left (without right of way?), may have turned into the main road, only after I started moving. I just called them to request for video footage and they said the PCN system is down at the minute and to call in a few hours when you'd be able to request video footage. The date of PCN notice is 20/07/24 and I received the post on 24/07/24. Any help would be much appreciated. I'm aware there are some good arguments in this thread, not sure if any of these could be applied in my case?<br><br>

Just an update here. I called them again (as still haven't received anything). First call was on 30th July. The person said they have raised it again and it's still on hold. I can see on status it says On Hold since 30th July. He mentioned to call by 9th September now if I still haven't received CCTV footage. I doubt I have any grounds already to challenge and best is to wait for the CCTV footage to arrive?

What happens if they can't provide me with the CCTV footage for some reason?

They must provide the video as it's the only way to know whether to challenge.

The photos show that there is a possibility that your space was taken by a car moving from the left we need to see the video to be sure. If so you have a solid appeal ground

Hi,

Looking for some urgent advice here. As you can see above, I had been chasing for cctv footage. I had to call them multiple times for them to just post the CCTV footage. I did eventually receive it on 23rd September I believe based on the letter. However, I never received in that document or any other document that the PCN is not on hold anymore. And I got busy with other stuff so did not make a representation assuming it was on hold. I have now received straight away 18/11/2024 dated a charge certificate saying 28 days have passed and I need to pay the full £240 now :'(

When I log in to the PCN portal I still don't see any date where it says PCN resumed/not on hold.

Do I have any recourse now or will I need to pay the full £240?

You had to make representations in reasonable time after getting the video - it seems they've allowed you a lot of time before issuing the charge certificate. Have to say this looks like your fault but see what others say.

But you can still make reps and they make consider them if you say you were expecting to see the status change to off hold.

I can't recall if TFL status says if a case if off hold - I don't think so.

But what letter are you referring to here:

Apologies for not being clear. I did receive the CCTV disc on 23rd September alongwith a letter, but the letter did not state that the PCN would be coming off hold now. Maybe I misunderstood but I was expecting another letter saying the PCN isn't on hold anymore as we have provided the cctv footage to you (stating the date it will be coming off hold).

What did TfL tell you when you requested they send a video.

I have to say that I think you have kyboshed yourself by not responding promptly to the PCN after receipt of the video. TfL normally put the PCN on hold for 14 days when a request is made. There is nothing in the process that demands they tell you a PCN has been taken off hold, but they should really have told you how long the hold period is.

Thanks for the responses so far. Have attached the letter I received (at the time I received the footage). Waiting for external disk drive to arrive before I can share cctv footage 😆. The letter doesn’t mention anything about how long it will be on hold for. As you can see from above I put in original request on 30th July and after multiple calls they sent the footage on 23rd September finally. The process has been drawn out on their end as well. On the calls I did check that it won’t come off hold without me being told about it but that was at the time I was calling to request footage. So not too sure if once you received it, it’s implied that the PCN isnt on hold anymore.

As far as I know, they just put the PCN on hold for 2 weeks. We have seen people with your situation before, although most people do get a move on when the video is received. I'm afraid it is your tardiness that has lead to this situation, and I can't see any way out of it, frankly. You could try ringing TFL and ask for an indulgence following your misunderstanding of the process. There is nothing in the next stage, (Statutory Declaration), that would allow you to get the process reverted.

Thanks. I did call them and mentioned about the misunderstanding. They have said put your reasoning and they can review the call logs to see if I was misinformed. Anyways, here is the video finally if someone thinks I have a case for making a representation?

Well, I have to say your chances of getting this PCN cancelled on the contravention itself look nil. You entered the box when there was already a stationary vehicle barring your exit. The only possibility is a collateral challenge based on irregularities in TfL's management of the enforcement process. Except you're well past the period for submitting reps.So you need to submit something to TfL just stating that you were not aware TfL only put the PCN on hold for two weeks after your video request, and you expected something from them to advise you the video was on its way.
