Author Topic: Ealing Council - 53J Failing to comply w/ restriction in pedestrian zone - Pierrepoint Road Acton  (Read 242 times)

I have received three PCNs for the same contravention as set out in the folder here.

On those dates, there were works on the usual route (Mayfield Road to Horn Lane heading west via Creswick Road) which led to redirection signage down Pierrepoint Road. The redirection signage took drivers through an Ealing school streets zone.

I have written to the council with image evidence (I haven't shared the video yet) and explained that the contravention was the result of works on the road and a redirection sign that was clearly conflicting with a school streets programme. I didn't know about this website at that point.

What should I do next. What if Ealing rejects the appeal? I am keen to fight this at Tribunal if there is a reasonable prospect of success. It seems a bit tyrannical to me to be honest!

On the last video, right at the end, the diversion sign is shown directing traffic into Pierrepoint Road, so this is obviously your main point against the PCN.
I tried to view the video of one of the PCNs but the complete trash that is the Ealing website doesn't work properly.
I suspect it doesn't show the diversion sign.

You need to submit reps against all three PCNs referencing the two others on each representation, and also point out it is impossible to view the video, but you attach photo of the diversion sign. State that a diversion sign must override whatever restrictions are imposed on the road one is diverted along.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
