Lambeth Code 40 Parking in a disabled bay
« on: »
In December, I was given a ticket for parking in a disabled space (Contravention 40). Just to be clear, I think taking disabled space is reprehensible. The issue here was that I didn't realise it was a space because the signage was so bad.

The international disabled symbol was worn away, as was the lettering and the box markings. The sign was bent away, so that it couldn't be seen either from the driver's seat or when getting out of the car. I used the council's (Lambeth's) informal appeals process making this points and including references and photos. Today I received a letter (almost two months later) saying my appeal was refused and the "sign was not faulty and The road markings were faded but enforceable".

I now understand have the option to take this to formal appeal but will lose my "discount" and pay £160 (or maybe £240 - see below)  if I lose at appeal or take it on to tribunal and lose. In note that the online portal threatens me with £240 fine while the ticket says that to pay in full (if I don't choose to take the discount) is £160 - which sounds like scaremongering sleight of hand.

Part of me knows that it would be less painful to take the hit and move on. But I'm so angry about it as a matter of principle.

I have subsequently taken my own photos of the parking spot when it was empty to show the issues (note the turned away sign and the erased markings).

(I have written separately to the council and councillors asking whether they think the state of the bay is appropriate and suggesting it puts them in breach of their statutory duties to disabled people).

Thank you in advance for help anyone can give!

Sorry - I was looking at wrong end of road. There is a disabled bay there but you can check on the map if it is where it is supposed to be.

The upright sign is there to be seen I reckon.
