Parked wholly or partly in a suspended bay or space

Long story short.  I parked in a suspended bay.  There was a warden nearby, who said that the works have finished and said it's fine to park here.  I paid by Ringo.  Came back 10 minutes later to a ticket.  Tried to challenge but it got rejected. Response below:


Thank you for your letter received on XX/05/2026. I understand that you are contesting the
Penalty Charge Notice (PCN), but I have decided to enforce the Notice.
The Civil Enforcement Officer (CEO) observed the vehicle parked in a bay suspended for
domestic removal. Bays are suspended from time to time and it is important to keep the area
clear to allow the activity it is suspended for to take place. Any vehicles parked within
suspended bays may cause an obstruction which can result in further suspensions.
You have stated that you were advised by a traffic warden that the roadworks had finished and
that you were permitted to park, after which you purchased a parking session via
RingGo. Whilst it may appear that the suspended area is not in use, many suspensions require
the suspended bay intermittently. We are not able to constantly monitor the usage of each
suspension, but we do encourage customers to cancel their suspension if it is no longer
required via the self-serve system.
If you believe a suspension is no longer needed, please refer to the ‘unused suspensions’
information at Parking bay suspensions - Camden Council . We can then contact the applicant
to determine whether the bay can be reinstated early. Drivers should not park within a
suspended bay until it has been reinstated.
The relevant signage stated the paid for parking bay, four consecutive spaces outside 6A to 9A
Hampstead High Street was suspended for domestic removal and the parking suspension was
in force between 8am to 7pm from 11/05/2026 to 12/05/2026. Although I have noted that you
made payment via RingGo, this would not provide any parking concession where the bay was
suspended. As the suspension information was clear and your vehicle was parked in a
suspended space, I am enforcing this PCN. For further information on parking bay suspensions

Given the above I am satisfied a contravention occurred. I have reset the discount charge for
14 days from the date of this letter and will accept payment of £80.00 in settlement if received
during that time. After this period the charge will revert to £160.00.
You can pay this charge online at camden.gov.uk/pay or you can contact our 24 hour
automated payment line on 020 7974 6104.
If you choose not to make payment we will send the registered keeper of the vehicle a Notice
to Owner. This statutory document explains the grounds on which the registered keeper of the
vehicle can make formal representations against the issuing of the PCN. I must make clear that
the discount period for payment will have expired by the time a Notice to Owner is issued, and
the charge will have reverted to the £160.00.
Please also be advised that if the council does reject any formal representations that are made
by the registered keeper of the vehicle the registered keeper will have the option of appealing
to the Environment and Traffic Adjudicators who are an independent adjudication service.




It's a lease vehicle.  Should I just pay, or can I actually appeal?

YOu need to find out how the lease company deal with a Notice to Owner. Many of them just pay it, then off-charge it, plus the inevitable "admin fee" on top. As the hiree, you have no legal role in the enforcement process unless the lease company submit representations against the NtO naming you as the hiree on the day of the contravention. If their reps are accepted, you will get a NtO in your name.

Thank you.

I can speak to the lease company and ask them to potentially send it in my name. So if I can do that, do I have a case to appeal this - or should I pay the 80.

The lease company have to submit reps to the council on the basis that they are a hire/lease company and provide your name and address. If the council accept these reps they cancel the NtO, and send another one to you.

Your basis for an appeal is that you were told by an official of the council that the suspension had finished so you could park there. How close is the time between your advice from the CEO and the time on the PCN ? It could be he was being mendacious. Not a hugely strong appeal argument if you cannot quote the CEO's Number, although the council should know who was patrolling there at the time.
