Bus Lane - Shepherds Bush Road Southbound Offside PCN

Hi all,

I googled the site of the offence and this message board was immediately in the top suggested sites on Google. Glad to have found this, seems to me that this section of road have been infamous for catching motorists unaware.

I was caught in the bus lane on the 27th of March, the date of the notices (shown below) is 18th of April and I was only notified of this today by my company's fleet management and leasing company.

I understand being able to appeal if it was my own car but how do I do this if it was a business loan vehicle?
Unfortunately the leasing company has paid for the fine, so there's not much I can do for that.


Any information would be helpful.

As I understand it, the PCN has been paid and the case is therefore closed.

Your beef will therefore be with the leasing company.
What are the terms of your lease agreement regarding paying PCNs?

That's frustrating.


According to their Document on PCN's:

"We will look to either transfer liability or pay the fine
to take advantage of the reduced rate that is
usually offered. This is dependent on the type of
fine and the authority who issues it. We will contact
you upon receipt of any fine relating to your vehicle
and detail how we have processed it. "



And regarding appealing fines:


"Appeals can be made directly with the issuing
authority, either online or by post. Please include the
third-party authorisation letter which is included within
the email notification for the fine.
...
If your appeal is successful, the issuing authority will
issue a refund to Alphabet which we will then pass on
to you. Please be aware that refunds can take up to 28
days to reach us, but once we have them we’ll credit
them to you within 30 days of receipt."



I've tried to check the PCN and according to LBHF it's now closed.

Hang on a minute. In bus lane law, they are liable not you, the hirer.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

The terms are irrelevant because the law is an ass and they are liable. I am happy to draft a letter of  complaint to both organisations. Another messy situation.

Yes please, they've (the leasing company) basically attached a letter telling my employers that they have liability to appeal.

My employers are basically passing the buck to me. I would much rather pursue this myself as I have more control over the narrative than they are (as well as the fact that they're taking the fine and admin fee out of my pay). If I am able to send the appeal letter, I can chase this up more as I'm not confident my employers care enough to do it themselves.
