Bus Lane PCN but never received a First Notice -

I Received a Bus Lane PCN on 30th Jan from Basildon Council- was just about to pay it when I noticed that they had apparently issued it previously on the 23.12.24 - and now it has doubled - I have never received the original. Who do I speak to ?

It is not a bus lane PCN, it is a Charge Certificate, served because no response was received to the original postal PCN, (paymnt or representations). A CC adds 50% onto the original PCN penalty, and means you cannot submit reps, only pay it.

However, there is a very simple way to revert back to the PCN stage.  You wait for something called an Order for Recovery, (which has £10 added to the CC amount). You can then submit a Witness Statement to the Traffic Enforcement Centre that you did not receive the PCN. The matter is then set back to the PCN stage. The council will then serve a copy of the PCN, which you can then pay or appeal.

Don't let them browbeat you with threats of "County Court" because only TEC are involved, a form of court without court rooms or judges. There is no possibility of a CCJ whatsoever.

Thank you for this- I must have gone in the bus lane - they seem to spring up overnight .. so am guilty but definitely never received the first notice... will follow your advice and let you know what happens

Are you the registered keeper, and is your address on the V5 correct? Is this the address the charge cert was delivered to?

Edit - Video is on the ECC website, your car clearly drove through the bus gate, although you realised and made a U turn immediately.  Contravention would appear to be made out, but there might be issues with the PCN or local signage once you get it back to that stage.

I am the registered keeper - I live in the area and was going the route I would have done in the past - admittedly I haven't done it for a while and realised once I was in it that it was now bus lane - then carried on the way I would have in the past..

I called the 0300 number and it had not been registered - called again last week and was told by the operative that it would not be registered at Northampton and jut to wait for the Recovery Order and appeal then, it arrived this morning .. seem a bit too easy just to state that I never received the Original PCN..am I over analysing..
