Hello everyone,

I have received PCN for parking on a bay with barely visible marks,Code:622.
On Havering Traffic Orders web this is 2 wheel park nr 110 and 111 from 2018 till present day.
At PCN review form there are no photographs uploaded,after 3 days from PCN issued.

Can you please advise if this is straightforward their mistakes(imo yes) as there are no visible bay marks,or something else?

Havering upload photos today.It must be about invisible lines,people are parking there on regular basis and it was nothing wrong with that until now.

I thought the same, but on further examination and comparison with GSV I think it's just an accumulation of moss on a poorly maintained footway!

Regardless of the exact position of bay there may be a resolution misapplying the footway ban in the area anyway.

But clearly you have a solid challenge that the contravention not occur and refer the council to its own map.

The Council's case is that the Appellant's vehicle was parked in breach of the prohibition against "footway parking" in Heathfield Gardens on 30 May 2024. A penalty charge notice was issued at 09 31.
The Appellant, who lives nearby and maintains that the correct location in Sutton Lane North, states that there is an exemption to the statutory prohibition against "footway parking" at the location; that the markings on the carriageway are faded, worn and inadequate and that any extent to which the nearside of her vehicle was not within the markings was "de minimis". She has submitted a series of photographs of the location in support of her contentions and reminded me that she parked at night when it was dark.
The Council seem confused about this case. In the Notice of Rejection dated 18 September 2024 they assert that there are no signs permitting footway parking at this location but in the very next sentence state "whilst footway parking is permitted in this area…"
I have carefully considered all the photographs including those of the civil enforcement officer. There are faded white lines painted on the footpath, which I accept are intended to create an exemption to the prohibition. I further accept Ms xxxx's submissions. The signage (by means of the markings) is worn and inadequate to convey the extent of the exempted area. Further, and in any event, I consider that the extent of any infraction by her vehicle was so minimal that the law will not enforce it.
For all these reasons, the appeal is allowed.

I’ve recently been issued a PCN by LB Havering for the same contravention (Code 62 – parking with wheels on the footway). All residents on my road park with two wheels on the footpath, and on the day the CEO issued the ticket, several vehicles were parked in exactly the same way — yet only mine was fined. I submitted an informal challenge, but it was rejected.

There are footway parking signs and bay markings on the pavement which clearly suggest that partial footway parking is permitted, although the markings are now very faded. This has caused genuine confusion for residents, and enforcement has never been applied consistently.

I noticed that you successfully challenged a similar PCN from Havering, and I would be extremely grateful if you could share the approach or wording you used in your formal appeal. It would really help me understand how best to present my case and reference the signage, markings, and inconsistency in enforcement.

Any guidance, examples, or insights from your experience would be hugely appreciated.
