Bristol, Code 17J Clean Air Zone, Newfoundland Circus, CAZ0023
« on: »
I (Registered Keeper) received a PCN today 23rd December, for driving in the CAZ without paying when heading to bristol then onto birmingham on 5th December. The day of the charge was raining very heavily to the point you could barely see the road let alone any signs, cars infront were slamming on breaks slowing down as i assume they couldn't either, i don't know if i have a basis for any challenge to be able to just pay the original charge but any advice would be greatly appreciated. @cp8759

Thanks in advance!

There is/was an issue with Bristol demanding the penalty + the £9 charge, but I am not sure it was ever resolved.

See, for example, https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/bristol-city-council-caz-a4-hotwell-road-caz0001/msg20672/?topicseen#msg20672

while you are waiting for the experts to chip in have a read of some of the threads which come up when you put bristol caz as the search term here

@Corneelius if you want to pursue this just make a one-line representation stating "the penalty demanded exceeds the amount due in the circumstances of the case", and let me know when you get the Notice of Rejection.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.
