Brent PCN contravention code 232

Hi,

My elderly neighbour received a ticket.
She parked in a loading goods vehicle only bay. She was under the impression that she could park in a loading bay as a blue badge holder but I think she is mistaken. Surprised she hasn't received more ticket if this is what she has been doing.

Can you please advice if there are any technical grounds of appeal be it the PCN wording or anything else.

Apologies if a little blurry i have asked her to send me a clearer picture but she may have wait for a family member to help her with it.

The bay looks a bit messy and the PCN doesn't state what is entitled to use the bay, which has won a couple of appeals we know, although the suffix 2 on code 232 does means goods vehicle.

It's usually worth asking for discretion for most inadvertent contraventions where a BB is involved.

It's not a loading bay, it's a goods vehicle loading bay and the contravention occurred because the vehicle was not of the class authorised to use the bay i.e. not a 'goods' vehicle.  Nothing to do with loading...although she wasn't loading either!

Appeals have been won where, as here, the PCN doesn't specify the 'class of vehicle' i.e.'...class of vehicle(goods vehicle)'

Bless her she had a go with chatgpt to help her and it came back with this which i have advised her against. I have drafted this for her, please let me know if I should include anything else.

Dear Sir/Madam,

I am writing to challenge the PCN. I politely request that you cancel the PCN on the grounds that the bay and signs were confusing for me. As a blue badge holder it can get overwhelming sometimes to understand where I can and cant park. Also the layout for this particular bay has changed recently which added to the confusion.

Furthermore the PCN does not specify the types of vehicles that are able to use this type of bay which as required to do so. Please use your discretion and cancel the PCN.

As she doesn't have a 'silver bullet' statutory defence the draft seems fine for this stage IMO.

The pcn is too vague, it does not set out why the pcn has been issued, it could be a doctors bay or a motorcycle bay etc
