HaVering 53J resident - Help please

Havering council, 53J, St Neot's Rd/Amersham Road, Failing to comply with a restrictions on vehicles entering a pedestrian zone.


So we just purchased a house on said Amersham rd on the 10th of October. There is school at the other end of road and the road actually has restrictions in the morning 7:45-9:15 or so and in the afternoon. It does state unless permit s11. Now I have stupidly assume that the permit would be lets say for parents of the kids etc, not for the actual resident. I thought as we had purchased our house there and registered for tax we are automatically exempt. I thought this was logical for me as I did not think they could restrict your access to your property.

Anyways.. As I had to attend Friday morning to couple contractors coming between 8-11am with my partner, I have entered the road to park our car on our drive way. I have received penalty for this. I am now awaiting another as I had to go the following friday (last week) also to meet with a skip company who were coming 8:30-9am.

Since receiving the penalty I have spoken to a neighbour who advised even tho we own a property on said road we have to apply for resident permit on the havering website and we need our council tax account reference and v5. The problem is we only received our tax bill on friday last week and it is clearly dated 17th of October (I had to contact them during the first week as it said we will receive email but never did) and our v5 we are both still awaiting. Since we found about the permit we have registered and tried to see if we can apply either way, however the system does not allow us and it keeps coming back saying the tax number is not recognised. There is nothing on the havering website that states what can be done when we need to access our property and cannot actually get the permit not due to a fault of our own.

Now I honestly cannot afford to pay the penalty. It is 160, reduced to 80 if paid within 14 days. 2 of them. I want to appeal it and ask them for gesture of goodwill to take them off as a new resident and not able to get permit as well as needing access to property. As this is a new area I would not be comfortable to leave my car on another road where I do not know it and walk as we had lot of tools with us we need to carry each time as well as my insurance will not cover me as it is set up for my car to be on a drive way not on a public road.

Please can somebody please help me with this, it was a genuine mistake on my part thinking we can access our home and we needed to meet contractors.

Unfortunately, you have moved into the most venal and rapacious council in all England. If you submit representations, they will not re-offer the discount when refusing. I say 'when' because they reject ALL representations. It gets the money in, and that is all they are interested in, nothing else counts.

Your text tells me that the only argument you have is mitigation which an adjudicator cannot consider. So you have a choice - pay the discount, or submit reps relying on them cancelling the PCN out of the goodness of their hearts.

I would suggest to you that you contact your local councillor and explain what has happened, and that you are new to the area. You might get a result this way.

I have seen someone mention before to contact local MP or councillor for help. I have no clue in how to do that, are you able to advise? Like where do I find local councillor and should I message them before I do anything about the fines or after? Any help appreciated!
