Hi all,

First time posting so apologies if I get anything wrong.

I could not get imgpile to work so sharing a google drive link instead of the PCN.

I have not asked for the CCTV video yet. I have read some comments saying I have to write to them to get it.
Is that via email or post? Could it be done via a call?

From the images shared the car in front of me does not have the turn right indicator on. I am not sure if this was the case when I followed in the junction. Only the CCTV would clear this up.

Look forward to hearing from much experienced campaigners if there is case to me made here.

Hi,

They finally sent over the CCTV footage after 11 days.

I did confirm with customer service if it fine with stay in hold for 14 days or 14 working days. It is 14 days, so last day to appeal is the 04/02/26 for me.

In the video you can see from the 1:42 mark that car in front of me does not have their right indicator on. I was the stopped at the yellow box for may be 4-5 seconds.

I hope my appeal on the basis of no indicator from the car in front will work. Is there a appeal template that can be used?

I don't think the lack of indicator will save you as you enter a box junction at your own risk if there isn't already a clear exit on the other side.

However, you should be in scope of the right turn exemption. You are allowed to enter a box junction for the purpose of turning right and wait behind another stationary vehicle which is also stopped while waiting to complete a right turn.

The legislation words it as follows:

"The prohibition in sub-paragraph (1) does not, in respect of a box junction within sub-paragraph (6)(a) of the definition of that expression, apply to a person who—

(a)causes a vehicle to enter the box junction for the purpose of turning right; and

(b)stops the vehicle within the box junction for so long as the vehicle is prevented from completing the right turn by an oncoming vehicle or other vehicle which is stationary whilst waiting to complete a right turn."

Reasons   
This appeal was listed for a Teams hearing. Mr Barry attended for the Appellant. He was the driver of the vehicle on the day. The Enforcement Authority relied on the evidence submitted in advance.

The contravention alleged is entering and stopping in a box junction when prohibited. The prohibition is contained in the Traffic Signs Regulations and General Directions 2002, Schedule 19 Part 2 paragraph 7. This provides as follows.

7 (1) Except when placed in the circumstances described in paragraph 8, [box junctions] shall each convey the prohibition that no person shall cause a vehicle to enter the box junction so that the vehicle has to stop within the box junction due to the presence of stationary vehicles.

(2) The prohibition in sub-paragraph (1) does not apply to any person-

(a)who causes a vehicle to enter the box junction (other than a box junction at a roundabout) for the purpose of turning right; and

(b)stops it within the box junction for so long as it is prevented from completing the right turn by oncoming vehicles or other vehicles which are stationary whilst waiting to complete a right turn.

There are two box junction’s close to each other. The Appellant’s vehicle is seen to follow another car into the box and both vehicles intend to turn right. The vehicle in front goes past the green traffic light and has to stop on the far side of the first boxes there are oncoming vehicles preventing his right turn. The Appellant’s vehicle also has to stop behind him. The traffic lights change to red and so neither vehicle can drive on.

At the time the Appellant’s vehicle entered the box the lights were green and the vehicle in front was turning right. The closeness of the two boxes leads to the dilemma.

I find that the right turn exemption applies in these circumstances.
