Birmingham Clean Air Zone Autopay
« on: »

I recently (less than 4 weeks ago) drove a couple of days in Birmingham within their clean air zone. I’ve already got autopay set up for London as I do a fair bit of work down there, and I set up an autopay for Birmingham too so save having to pay it all individually.

I had, apparently wrongly, assumed that it’d work like the London zone where I’d just get a direct debit come out a few weeks after travelling.

Yesterday I received a penalty notice through. And I received another one today.

I still have the email confirming that the direct debit was set up but they don’t appear to have taken it.

Do I have grounds to appeal the 2x £120 fines on the basis that I set autopay up and they haven’t taken it?

Sorry, but we need more info, so please post-up the documents, with name and address redacted.

Did you set-up autopay before or after you travelled to Birmingham ? Also was the autopay facility set up before or after the last date for paying the toll fee directly ?

@NottsDriver you need to read the guidance here and post up the relevant documents, otherwise no meaningful advice can be given.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.
