Son has Tourette’s ASD and adhd had to get him out wasn’t blocking anybody before he has fit, to nearest toilet - Waitrose

No grace period given at all on ticket

Anything to help here

Displayed disabled badge but they’re ignored

looks like a yellow line across the DK.

The BB does not offer an exemption for the contravention of parking adjacent to a DK

Regulation 86 of the TMA governs this contravention and at 86(8)(b) the following exemption exists

(b)the vehicle is stopped, for no longer than is necessary, for the purpose of allowing people to board or alight from it.

Boarding alighting a vulnerable person who requires assistance to keep them safe is allowed and that is the line i would take in moving forward

We haven't seen the OP's challenge, but we can infer certain matters from the council's reply:

1. The OP claimed that they had permission to park at the location, presumably from the occupier of the premises served by the DK.
OP, if so then all you need to do is produce this to the council and you won't need assistance because the PCN will be cancelled. You might want to post here first. There will not be any need to rely on another exception such as assisted alighting.

2. On which point, the response says that the council were alerted by information from a resident and on this basis they despatched a CEO. This would appear to directly challenge the claim that the occupier had given permission. It must surely also mean that the car must have been parked for some time i.e. the occupier notices, phones the council who determine that a CEO should be sent etc. surely this must have taken at least 15 minutes!

Your Notes: I was parked out using a blue badge I asked the same officer before leaving car there and he advised me wrongly to display my disability card and it should be fine - I wonder if he has deliberately done this to then later give me a ticket? It’s outside a friends driveway I am visiting and I have no choice but to put car outside their home with disability car I wasn’t blocking any carriage way see pic it’s my friends cars parked inside her own driveway and I had no issues from anybody. It was the advice I was given by warden officer If you check the pic you can see it’s outside resident home, and also my badge was displayed as advised Officer has not observed my vehicle for any length of time be has issued this fine when he gave advice to keeep it there quite corrupt and wrong of him just for issuing me a ticket and I’m vulnerable disabled person with disabled children. I will not be proceeding with this at all if you wish to take this up in court then that’s where it will end up. It’s not right for officer to advice such Way to only what appears to trick me. I even told him I’m visiting the resident in Parked outside. Can’t walk far so this is the closest I need. I hope you can appreciate the situation and as a good will gesture remove this fine ticket immediately to avoid further litigation issues and complaints against procedures not being followed and officers acting unlawfully towards civilians Many thanks for your time and understanding with this

The council have asked for evidence of the occupier's permission, are you able to provide this?

GSV would suggest that the dropped footway is for the purpose of giving access to an adjoining residential property and that the drive is not shared therefore your defence is obvious if you can provide this to the council:


(3)The second exception is where the vehicle is parked outside residential premises by or with the consent (but not consent given for reward) of the occupier of the premises.
This exception does not apply in the case of a shared driveway.

I will see if anything can be done but #1 suffer from cars all day over their dropped kerb and they park on the frontage themselves. People sit there with engines running or leave cars for ages so they cannot themselves get parked. It doesn't help that there is a car park within 50m for the same small shopping centre as where you availed yourself of the toilet. Ironically I had a chat with the resident eysterday and offered them 4 spare cones which I have and I was told they had bought some on amazon so you can see there is a problem.
