Barnet PCN Whilst Paying For Parking

Received a PCN for paying in a bay which requires paid parking. 

Appealed the PCN with screenshot of telephone evidence that I was on phone trying to pay whilst PCN was being issued but that has been rejected

Is this worth fighting?  Is there not a five minute grace window?

My evidence showed me attempiting to pay at 11:57 and the ticket was issued at 11:59 - What are my legal rights

I was at the car looking at the code to put in phone and the enforcement officer was hiding before putting ticket on taking a picture and walking away before I could grab him

When I saw him he didnt engage and walked away

Can you describe exactly what happened between you parking the car, through to the PCN slapping a PCN on your windscreen.  Most cases like this happen when the driver is not actually at or near the car.
Time is always allowed for payment to park; if it wasn't, nobody could park legally ! However, how much time is allowable is one of those undefined things that depends on circumstances. From what you have said already, you would seem to have a strong case for cancellation. Barnet are one of the more venal and rapacious London councils, but what you have received is sent out by all the London councils, being a Fob-Off letter. They do this because lengthy experience, (since an Act of 1991 !!) tells them that most people then cough-up. People pay because they know little about the process and are terrified of having to pay more so accept the discount option.

If you want to take them all the way, then if you are the owner as per the V5C Registration Certificate for the car, you should now wait for the Notice to Owner and submit formal representations.  It is quite possible they will accept your reps, but if they don't you register an appeal with London Tribunals, (a simple online request). Yes the full PCN will be in play, but when or if you win, you pay nothing, but Barnet will have had to pay £30 to London Tribunals.

I park the car and get out - I walk five metres to see the board to get the phone number and parking location code.  This is at 11:56AM

I call the number to pay at 11:57 and try and enter my card details

At 11:59 I see the enforcement offer at my car and approach him -

I see the ticket on windscreen and try and explain to him but he is not interested

I have proof I was on the phone to Barnet pay at 11:57

So, based on what you've told us, this is pretty much a 'slam-dunk' win at London Tribunals. But first you have to go through submitting reps against a Notice to Owner, then when rejected, register an appeal at London Tribunals.

Please tell us if you are the owner or not, because the above doesn't apply if you aren't. Only the owner can receive and respond to, an NtO.

The PCN and your VRM pl. Also, a GSV of the location. Pl repost their reply leaving in everything except your personal details.

We need to see the council's evidence as regards photos(to do which we need the PCN number and your VRM), also a GSV to assess where the traffic sign is located vis-a-vis your car.

Are you the registered keeper with current DVLA details?

Sorry for all the questions but we need to get these facts in play.

And once again, did you pay for a session?

Or did you drive away or leave the car with a served PCN?

Their reply was in the photo attached - Appeal denied

Either I pay 40 or wait and take to tribunal and then pay 80. 

I did not continue with the parking after I got the ticket - The enforcement officer basically hides in a shop window and then puts the ticket on the window
