Barnet council PCN - Contravention Code12
« on: »
Hi,

My first question is there a minimum time the traffic warden has to observe before giving you a ticket? On the ticket issues, he put observed from 11:21am - 11:21am

My second question is, I got a parking ticket for parking in a bay that has a restriction between 11am - 12pm. Where I parked was by a sign with a 9am - 5:30pm pay by phone. I didn't see the lines in the road and got out and went to the nearest sign and paid for a ticket.

So I paid for a ticket not knowing I was in a different parking restriction to the parking sign that was right by my car. In the photo is the sign that I went to by my blue car. Is there anything I can appeal apart from appealing to their good nature?

Thanks

Your story puzzles me. Please tell us the pcn no. and vehicle reg so the council's evidence can be looked at
I help you pro bono (for free). I now ask that a £40 donation is made to the North London Hospice before I take over your case. I have an 85% success rate across 2,000 PCNs but some PCNs can't be beaten and I will tell you if your case looks hopeless before asking you to donate.

If you look at the first photo, you can see the bays divider, delineating where there are two separate bays either side of it, with different restrictions. Clearly the OP missed these. It's a common problem made worse by councils not following guidance and placing the signs for each bay side by side on a single pole at the divider lines.

Just look at this; a malicious and devious trap for the motorist.  The sign for the bay to the right nearby, but the one for the bay on the left is about 30 yards up the road !

Sorry if it was confusing, Incandescent got it spot on, my car was exactly where the BMW i3 is parked on the Google Street View he linked.

I've attached the PCN and reg.

Any help appreciated,
Thanks

As far as I can see the road markings are correct, however these cases suggest the suffix wording should be used:

Andrew David Rush v London Borough of Southwark (2120562288, 5 January 2013)
Natalie van Dijk v London Borough of Islington (2150275729, 23 September 2015)

@J05HR when you first got the PCN, did you know what you were accussed of, or did you only work it out when you saw the photos on the council website?
