Barnet Cam PCN Beyond Belief!

Hi Forum,
I am seeking advice and assistance regarding a recent traffic incident involving a PCN issued by Barnet Council for an alleged contravention of code 48J - "Stopped in a restricted area outside a school, a hospital, or a fire, police, or ambulance station when prohibited" (camera enforcement).

The incident occurred when my vehicle turned right into a school entrance at a junction controlled by a camera administered by Barnet Council. Following the turn, another vehicle ahead began pulling out from on-street parking during a busy pick-up time. To ensure the safe passage of oncoming traffic, my vehicle came to a stop near the zigzags in the middle of the road. This maneuver can be clearly observed in the provided video evidence, particularly at second 10, where at least one vehicle can be seen passing by on the right side of my car. Subsequently, my vehicle continued its journey without any individuals entering or exiting the vehicle at any point.

In our initial appeal to the council, we explicitly stated our awareness of the relevant regulations prohibiting waiting and parking outside schools, as we have received PCNs in similar circumstances before. However, the council's response indicated a misunderstanding, suggesting that we were unaware of the rules, which leads me to believe our appeal may not have been thoroughly reviewed.

Under the circumstances, my wife, the driver, had no viable alternative to navigate the situation without creating a bottleneck or endangering herself or others by attempting to proceed into oncoming traffic.

Despite reaching out to our local MP for assistance, I am uncertain about the effectiveness of this approach. Therefore, I am considering appealing to the London Tribunal and would greatly appreciate any insights or suggestions you may have in making this decision. @plesen there is no point in holding back key details, the council already has all the evidence they're going to use against you.

So, please read the guidance here and then post up the PCN, your representations and all pages of the notice of rejection (but not the tribunal appeal form).

Do not redact the PCN number or number plate please, the council have this information already anyway.

You MP cannot help you, not because they don't want to but because they simply won't have the legal knowledge.

@plesen you might have a viable appeal, but you need to expand slightly on your reasons to make any appeal watertight.

So, it's a wide road with two full-sized lanes in each direction and the blue SUV can be seen to pass you with no difficulties. This being the case, you need to explain why you were unable to proceed in your own lane. Does the carriageway narrow out of sight of the camera? Was there a box junction or roadworks ahead? Was there some other sort of issue with the flow of traffic?

It might help if you draw a rough map indicating the position of the vehicles ahead with respect to yours and the zig-zag lines.

The approaching car does seem to be pulling out of your lane as it comes into shot which would support the fact there was some sort of congestion ahead preventing you from proceeding.

it is evident that the road in question may not be as wide as initially indicated.

Furthermore, upon examining the attached images taken over the weekend, it is apparent that there was indeed a building site on the right-hand side. While we do not recall the specific circumstances of the day in question, it is plausible that a heavy vehicle was parked there at that time.

Additionally, based on our experience on this road, it is common for traffic flow to be obstructed when two vehicles are parked on both the left and right sides of the road. In such scenarios, it becomes necessary to wait until the passage is clear.

Considering these factors and the brief duration of the recording, it is likely that several other vehicles passed our car following the blue SUV.

At this juncture, I seek your guidance on the next course of action. Would it be advisable to escalate this matter to the London Tribunal? If so, could you please advise on the appropriate wording and address for correspondence with the organization?

It is disheartening that significant time and effort must be expended on what appears to be a straightforward issue.

We have had no interest in parking in that location, and the delay was solely attributable to prevailing traffic conditions.

Your assistance and insight into the next steps are greatly appreciated.

Spot on!

There exists no other rationale for halting in the center of the roadway.

Our intention was simply to facilitate the passage of other vehicles by extending courtesy.

It is incomprehensible that an act of kindness and consideration could result in receiving a PCN.

Thought the road looked familiar - just realised I used to visit that school each weekend for Russian language classes! Much quieter on Saturday mornings although the road up to the school is single carriageway as I recall so even then there can be some waiting around near the entrance  if there are multiple cars coming out as you arrive.
