Good evening.

My mum has her car registered at our old home. We have now rented it out and live elsewhere. Mum forgot to change her address with DVLA or thought she had.
I infrequently visit the property. I visited today and picked up a few letters. It seems mum has recieved two PCN's ( for the same offence but on different dates ) and they are at the final stages!

I would appreciate everyone's help.

Needless to say, their letter saying they are just about to register the £195 debt of the Charge Certificate is not part of the enforcement process.I would say it gets close to being unlawful.  Their next stage is to register the debt at the Traffic Enforcement Process and send you an Order for Recovery. This adds £10 onto the £195, being the TEC registration fee. At this stage, your mother can submit a Statutory Declaration that the PCN was not received, (one declaration per PCN). The OfR and CC are then cancelled by TEC and the matter reverts to the PCN when it can be paid or appealed.

You now need to be super-proactive and make sure you know when the OfR has been sent off. It will be sent to your Mum's old address. However, you don't have to actually receive the paper copy because you can download the form from the TEC website. There is only a limited time from debt registration for submission of a Statutory Declaration, so yu need to keep an eye on it. You should phone TEC once every 10-14 days to ask if the PCN has been registered. If you can see the PCN record on the B & D website with the amount outstanding, then when it gets to £205 you know it has been registered and you can submit your SD.

When filling it out, remember that the 'Applicant' is the council; you are the 'Respondent'. There is no need to put anything in the 'Reasons' box, as you will be submitting in-time, not out-of-time.

As said by Incandescent but you need to realise you have been fortunate in intercepting these before they escalated beyond debt recovery to bailiffs, at which point your mother probably had no defence as the notices were served to the registered keeper's address and maybe not changed with DVLA in a timely fashion.

Make sure you monitor the post for anything else and that the logbook address is or has been changed.

On the PE3 form,

You must then have the form sworn before a Commissioner for Oaths (e.g. a Solicitor), a Justice of the Peace (at any Magistrates Court) or an officer of your local county court before sending the declaration to the Traffic Enforcement Centre at the above address. Is this really needed?  :o

This is going to be a problem. Mum has been on holiday from 21st February and will come back on 17th June.
Can we not send this info to someone to gett the PCN's back to payment stage?

Good afternoon.

I have met mum and obtained signed PE3 forms.
I contacted TEC last week and it seems the council has still not registered either of the PCN's.

Hi everyone.

I have checked with TEC yesterday and the council has still not registered the fines with them!
