BAILIFF delivered by hand

Hi there
When visiting our old neighbours last night, they gave us some post that had not been redirected by the Post Office.

There was a PCN charge for driving in a bus lane which has not been paid because it was sent to our old address.
The date of the incident was 28/10/24.

The most recent correspondence received is a hand delivered bailiff letter (not dated).

I have attached all of the correspondence sent to our old address

I moved house in October last year and changed my DVLA / Licence and insurance within 2 weeks of moving to the new address.

I have checked on the TEC website and I am confused as to which documents I should be completing and sending back.

Please can I ask for your assistance in dealing with this? I do not want to contest the original penalty charge, I just want to get the PCN back to the local authority so that I can pay the original amount of £35 (which I would have done if I had received the notice).

so you did this right and an out of time declaration should succeed to get it reverted to PCN stage.

You mention mail redirection - did this fail?

The bailiff probably hasn't yet got a warrant for your current address and I presume hasn't contacted you but they no doubt will.

Do you have any evidence that demonstrates that you updated the RK details prior to 28th October 2024? If you applied online the DVLA would have sent an acknowledgement email.

Thank you for your help.
I redirected mail until Jan 2025 and one or two letters were redirected but there were a few including the 2 x PCN notices received that have obvs not been redirected. I hadn't given this much thought until last night because I had notified all of my bills / insurance etc that I had moved (and trusted that my mail would be directed).

I have not yet contacted the Post Office to make a complaint but I will.

I'll complete the TE7 & TE9 and get it sent off.

If the bailiff contacts me in the meantime, I'll show them copies. If I understand correctly, once the forms have been received by the TEC, the bailiffs have to back off whilst it is being reviewed?

@Enceladus, the date of the penalty was before I notified the DVLA of the change of address (within a couple of days)

Do not file any forms without drafting here first. You only get one go at this and we've seen people muck this up.

Please can you check the following statement I intend to use? ---
Form TE7 Application to file a statement out of time/extension of time --Address (new address) --'REASON'-- I DID NOT RECEIVE PENALTY CHARGE NOTICE BC93076718 ISSUED ON 01/11/2025 BECAUSE IT WAS SENT TO MY OLD ADDRESS. I MOVED ADDRESS IN OCTOBER 2025 AND IN BETWEEN MOVING INTO MY NEW ADDRESS AND CHANGING MY LOG BOOK ADDRESS ON 15/11/25, PENALTY CHARGE NOTICE BC93076718 WAS ISSUED AND SENT TO MY OLD ADDRESS. I DID NOT KNOW ABOUT THE PENALTY CHARGE NOTICE UNTIL 03/04/25 WHEN I VISITED OUR OLD NEIGHBOURS WHO GAVE ME SOME LETTERS THAT THEY HAD BEEN GIVEN BY THE NEW RESIDENTS OF OUR OLD ADDRESS.

Won't convince TEC IMO. The issue is when these events occurred, not whether they did.

Precision pl. If we need to finesse the phrasing then we can but try.

Moved: ******* date?
Applied to change V5C: by what method and when?(you did not 'change my log book address on 15/11, DVLA did).
Pl get the years right, don't give TEC an easy reason to reject.

And mail forwarding has nothing to do with the Post Office, it's a Royal Mail service.
