Hi

The driver of the vehicle received a PCN with contravention 47J stopped on a restricted bus stop or stand (approved device)

The driver was dropping a passenger and there are no other places to stop as the road is a dual carriageway and a council camera vehicle must have driven past and taken the images.

The location on the PCN is incorrect and there is no road with that name in the city and therefore no bus stop exists at the location stated on the pcn.

Would the wrong location succeed on appeal and are there any other grounds for appeal such as approved device vehicle etc.

wrong location is normally a fatal error on a PCN, but if the street name on the PCN is similar, (so 'lane' might be 'street' or 'avenue' then an error like this may be allowed by an adjudicator. So where was the vehicle actually parked ? If totally different, then take them to the adjudicators. But first you must submit representations to Bradford, on the basis of the contravention did not occur, incorrect location.

The location on the PCN is not even within the council boundaries. Google search of location stated on the PCN is in another town outside the councils jurisdiction.


Pl answer the question, what was the name of the street where the vehicle was parked? We need this if only to look at GSV.

So the PCN is so wildly out in its stated location of contravention as to be void. Obviously, because it is taken from a moving vehicle, they have got the location completely wrong. If it had been a fixed camera, you'd be in much worse situation.

ALl you have to do is submit representations that you were not parked on any part of Brooklands Lane at the time and date of the alleged contravention. You therefore request that the PCN be cancelled forthwith. Don't tell them the actual location, they can find out for themselves but cannot issue a second PCN.

Therefore the driver is the RK, so why refer to 'the driver' as if a separate entity(overtones of private parking charge notice jargon here)?

If you are the RK but not the driver then the driver shouldn't have the PCN, it's for the RK to action. They could make reps to the effect that the vehicle was hired or similar (after all it is a PHV/taxi) if applicable and therefore relieve themselves of liability completely, or accept procedural liability and make reps on other grounds.

We've seen a couple of threads jeopardised recently for want of knowing who's who and unauthorised persons attempting to make reps.
