Author Topic: Advice requested please: Yellow Box Violation EAST INDIA DOCK ROAD / ST LEONARDS RD  (Read 731 times)

I was driving a hire van when I stopped with the back of the van inside a yellow box at EAST INDIA DOCK ROAD / ST LEONARDS RD.

Currently I received from the hire company the notice of the violation and also the copy of the PCN they received (https://drive.google.com/file/d/1-4MkmnLg_zlrGp5m3lo0yk0Do9Li8Sw1/view?usp=sharing), they have informed me that my details have been sent to the issuer for transfer of liability and reissue of the fine to me in my name. I have a couple of questions.

1. When the fine is re-issued in my name, will the reduced rate of fine period of 14 days be applied from when the fine is reissued to me? Must I wait to receive the fine reissued to me before I can do anything?


2. When I entered the box junction, there was sufficient road clear at the exit for me to fully leave the box junction, however after entering the junction (which is particularly large) a car ahead changed lanes to fill the empty road which would have allowed me to exit the box junction fully. So the reason I had to stop inside the yellow box junction was not because of a stationary vehicle but because by the actions of the vehicle ahead to my right which was a moving vehicle.

I am confident that if the council have video/CCTV footage of the incident that it will verify that this car cut across to fill that space after I already entered the box junction.

I wanted to ask if this is good grounds to appeal, and is there a particular way that the challenge should be worded?

I would be very grateful for any advice that can be offered.

When you get your own PCN the discount starts again but you'll need to ask TFL for the video, which unfortunately they still send on a DVD. The video is the only way we can assess the contravention.

They put the PCN on hold.

You may have to pay the hire firm an admin charge?

Yes, thank you I have paid the hire firm an admin charge already, no way I can avoid paying that it seems!

Until it's your PCN you have no standing but you could try asking I guess.

Is the address you used to hire the van your current address - we see people getting into a mess because they hired a van to move home...
