Author Topic: Please help: Abbey Road, Merton PCN 52J failing to comply with a prohibition on certain certain types of vehicle LTN  (Read 213 times)

Hi everyone

This is my first time ever posting on this type of forum (well any forum whatsoever) and my reason is that I feel that this PCN is totally manufactured, and I'm frankly sick of local authorities using them as a revenue raising exercise.  This states that its about limiting traffic but it geared towards fining, not reducing traffic. The PCN arrived on Friday 5 December, dated 17 November, appears to have been issued on 2 December and gives only 14 days to pay a lower amount, but doesn't state whether or not this includes contesting the circumstances?

Even as I was viewing the 'footage' of this PCN I thought that it related to the road to the left of the junction with the width restrictions on Abbey Road and checked the footage over and over to see if my tyres went over the line.  However, once I searched on the specifics online I can see that the signage is very unclear and doesn't give a driver any chance of seeing it, reacting in time and avoiding a fine. 

Like others I have used this route for many years.  I have put together stills of the video capture of my PCN, in the hope that it gives a good argument for lack of clarity.  There was a high sided vehicle parked in front of the sign on the day in question.  Like others, I did not see any prior signage denoting that there was no through road or that the road use had changed.  There were 7 other priority visuals including a pedestrian, width restrictions, width sign, another car and 2 parked vehicles.  Without looking significantly up and to the left to clock the sign which is unclear at best.  Again, by the time I would have seen the sign, there would be no space to turn around.  Any help would be very much appreciated. 

Any help would be so appreciated.  I have a document which I've converted into a PDF but I can't seem to insert it in my post.  I can send anyone who knows about this sort of thing the document or PDF showing my argument that I plan to upload to contest the PCN.  Either way, I'm not aware of legal terms to use, or the specific things I can say.   I saw another post on this forum from a person who'd received 4 PCNs and I can quite understand why, as I said even viewing the footage the sign is placed at the corner (just around the corner by the look of things) and you would naturally think it relates to a different road.

Apologies, I'm hoping I've got the right details down this time?  I've tried to follow the instructions.  I've never used drop box before, but here goes.

I'm at the first stage, haven't contested the PCN with the local authority yet.  Was hoping to get guidance first.

Here is a PDF of the specific frames that show the circumstances, I was driving, I am not phased by width barriers so tend to slow down slightly rather than stop.

My basic case is that I didn't see any signs on entering the road, nor any in the road.  The sign would have been behind a tall vehicle parked in front of it, and looks like the sign is located around the corner.  There was a pedestrian the footage even shows them turning after the sign, 2 parked vehicles, width barriers, width barrier sign, another car, and to see the sign, I would have had to look up and to the left as I approached the aforementioned priorities to see the sign, and probably saw it in my peripheral vision and just as when I viewed the footage, would have thought it related to the road on the left after the width barriers.

I hope I've put the right information down now, I'm not sure how to update a thread.

Hello again, I thought I put a good case together for the LTN, I even had a tall sided vehicle obscuring the sign but it came back rejected.  My father has just died, so as I've heard nothing from anyone I'll just go ahead and pay it.  Regards

Did they re-offer the discount?  If not, then you might as well appeal to the tribunal as there will be nothing more to pay.

Yes they offered the discount again I think, we've just held the funeral for my mother in law too, so I just thought I'd pay it.  It really does make me angry though, there's no way you can see that sign on the road and then there's no place to turn around and it is located in such a way that it looks like it refers to the road to the left and is actually positioned just around the corner.  It is legal extortion.
