33e Dulwich (Southwark) - Bus Gate not well signposted
« on: »
Hello all,

Newly posting here at FTLA!

I have recently received a Penalty Charge notice for the Contravention code 33e on the small roundabout at the end of Dulwich Village road.

PCN media - https://imgur.com/a/i2rQBYF

Events leading up to the contravention:
After having a coffee in Dulwich village, I took the southbound route on Dulwich village road. I needed to turn back around to head northbound towards Denmark Hill but took the southbound route as the angled parking bays in front of Redemption Roasters don't allow you to join the northbound route safely.

I decided to use the roundabout at the end of the road to make a safe u-turn to head back north towards Camberwell. As I approached the roundabout, I saw a sign indicating a restriction for cars ("Bus Gate") for the 3rd exit of the roundabout. The 3rd exit is Burbage road. However I took the 4th exit, i.e. going back the way I came. And the sign didn't show any restriction for the 4th exit. See below:

It's only when I reached the 4th exit on the small roundabout that a sign saying that exit also had a restriction appeared in my field of vision, but by then it was too late and I had gone through. The sign is directly adjacent to the exit and only visible when you are on the roundabout.

Strangely, on Gallery Road, there is another sign which shows that both the 3rd and 4th exit have restrictions. But the one on Gallery Road southbound only showed restrictions for the 3rd.

If there's any new advice on challenging this contravention code I would be eternally grateful to the members here.

Thank you for reading all of this and any help received happy.gif

We've seen this location before, but for some reason, GSV is not covering the roundabuot at the moment, so you need to do some leg work and take some photos for us to look at. Normally people approach from the roads on the south side where there are advance warning signs.

I've uploaded some photos at https://imgur.com/a/i2rQBYF (scroll down) where you can see the approach and the itinerary

Interesting !  All the signs one could want, except that a person doing a "U-turn" to go back up the street he's just gone down isn't covered.

@archiecarlos there's definitely an argument to be made, but as you've paid the PCN it's too late. As a general rule you should always challenge everything as the discount is invariably reoffered as long as a representation is made during the initial 14 day period. You know for next time.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.
