53J Momentarily entered school street in Islington
« on: »
Hi All,

I have already appealed this case and have received a letter rejecting my appeal. As I technically did enter the school street (turned around and left within 10 seconds), I was looking for advise if it is worth taking to the tribunal or if I am just wasting my time and money.

My appeal was as follows:

Dear Sir/Madam,

I am writing with regards to the above mentioned PCN. I am a long-standing resident of Richmond Avenue, which adjoins Matilda Street, and I hold a valid Zone E parking permit. While I fully support the school street restriction, especially as a parent myself, I rarely drive on weekdays and have always taken care to comply with local traffic rules.

On this occasion, I had an early morning appointment and, while returning home via Caledonian Road, I encountered an unexpected closure on Offord Road, which would usually provide access via Hemingford Road. I followed a diversion through Copenhagen Street, which led me inadvertently onto Matilda Street.

As soon as I turned in, I noticed the triangle shaped school warning sign and immediately realised the restriction might be in effect, even though no children or parents were present at the time. I stopped without passing the sign, then carefully reversed and exited the road the way I had entered.

This was an honest mistake in unusual traffic conditions, and I trust you will agree there was no intent to contravene the restriction. I have attached dashcam footage (https://drive.proton.me/urls/3YNTTT7D8C#QDOxeLmkLKq5) showing my actions, and I understand you may also wish to review your own CCTV footage for verification.

Given my longstanding compliance, valid resident permit, and prompt corrective action, I respectfully ask that you consider exercising discretion and cancel the PCN on this occasion.

Thank you for your time and understanding in considering my representation.

Yours faithfully,

The rejection:

Your reps could have been better if you wanted discretion as the key signs as you know are the zone entry signs and you confused them by referring to the irrelevant triangle sign.

I can't see anything here but Hippo may have something on the paperwork.

You can of course register an appeal and they may not contest but as they probably will you can show the adjudicator your webcam footage but you went way too far past to be in trivial category.

I can't post Islington's video as you've blanked the VRM but one of their pics show you well past the signs.

The timing was also well before 9.15 end time.

I have my novel arguments re the PCN as it is missing information. Later as is late.
IF YOU RECEIVE A MOVING TRAFFIC PCN PLEASE READ THIS BEFORE MAKING A REPRESENTATION:

How do we get more people to fight their PCNs?

It does sound like the odds of winning this is less than 50%, I only have another couple days left to take this to the Adjudicators, so I am leaning on saving myself doubling the fine and paying the reduced rate tonight/tomorrow.

Thanks you for trying to help @stamfordman and @Hippocrates, really appreciate it.
