Multiple Barnet Council PCNs A5 bus lane on motorbike
« on: »
Hi,

posting http://forums.pepipoo.com/index.php?showtopic=151892 here too as I saw news of that forum not being in use anymore.

On 06/10/2023 I went into London on a motorbike.
I think I read somewhere that in London bus lanes are a-OK for motorbikes so I just used them.
I think in some parts of London the signs are still not updated to motorbikes too even though they are allowed on TFL turf. This is very confusing.
Unfortunately, Barnet Council does not like motorbikes in their bus lanes and this was on a weekday at 6.45pm so the bus lanes were in effect.
I received 3 PCNs for driving on the A5 in the bus lane on 3 separate locations.
I believe I just stayed in the buslane throughout to be fair.
They are all timestamped within a minute.

I'm still in the discounted phase, I have until the 10th November to pay up or it will double.
65 quid each, which will double to 130 quid each.

I'm fine with paying one of them, even though I think it's bullshit that they allow bicycles but not motorbikes.
But definitely not all of them, I think that's taking the **** here.

I read some of the threads here and submitted a challenge based on the fact that I believe I've been fined for the same thing 3 times. I asked for the Traffic Regulation Order that specifies 3 bus lanes there.

"Hi, I received 3 PCN letters: AG44146057 AG44143117 AG44143795 the dates and times are very close on these 27/09/2023 at 18:46:02, 46:48, 46:40 all on the A5. I believe I
may have been fined for the same bus lane offence 3 times. Could you please send me a copy of the Traffic Regulation Order that specifies 3 bus lanes there?"

I got a response in a letter yesterday that they uphold all 3 penalties. There doesn't seem anything that addresses my request for the TROs.

I have in the meantime moved permanently to Spain, but I suppose I still can't just ignore these unfortunately.
Nice parting gift from Barnet really.

My questions are:
1) Can I just pay one of them on time (65 GBP) and challenge the other two?
2) Do I now need to take these to tribunals?
3) Do you know of any other technicalities based on which I can challenge them all?

For example in the colour shots my number plate is too blurry to be readable. Only in the black and white (flashed) shot it is readable.

The painted white lines are quite worn down almost completely disappearing in parts. This is well visible in some of the council's videos/photos.

Many thanks!

Google drive link does not seem to work
I help you pro bono (for free). I now ask that a £40 donation is made to the North London Hospice before I take over your case. I have an 85% success rate across 2,000 PCNs but some PCNs can't be beaten and I will tell you if your case looks hopeless before asking you to donate.

@buslanemfer22 none of your links work, please re-post them.

As above, cannot read the PCNs.  This is important to resolve as their PCNs are flawed. Unless they have corrected them.
IF YOU RECEIVE A MOVING TRAFFIC PCN PLEASE READ THIS BEFORE MAKING A REPRESENTATION:

How do we get more people to fight their PCNs?

Seems only to be the front page. I always like to see the whole document, for one PCN will be sufficient.

The PCNs say

If the Penalty Charge is not paid before the end of the 28 day period beginning with the date on which the PCN was served, an Enforcement Notice may be served....

What the 1996 Act (as amended) says is

(c) that the penalty charge must be paid before the end of the period of 28 days beginning
with the date of the notice;

(e) that, if the penalty charge is not paid before the end of the 28 day period, an enforcement
notice may be served by the council

Therefore the PCN wrongly states the timetable and even though it gives you typically two more days it does not reflect the law, prejudice or lack of it is irrelevant, and an adjudicator, once we get there, should cancel the PCNs.

Just sit and wait for the Enforcement Notices and then let me have them on arrival. I will be your representative. email: mrmustard@zoho.com
