Author Topic: 2 PCNs 1 min apart for entering & exiting a No Bike/Car zone : charged 2x for 1 infringement  (Read 366 times)

Hi All,

Last year I went to London, got lost and drove into a No motor bike/Car zone and did a three point turn within 1 minute. A few days later I recieved 2 fines from Hackney council. One for entering the zone and the other for exiting it (is this legal?). I wrote to them asking them to cancel the one when I exited the zone but their reply simply ignored my question and requested that I pay all the fines. I paid for the one when I entered the zone and tbh I should not have since it was dark and I didn't see it at all.

They have been sending threatening letters and now bailiff letters threatening to take my car. I did not receive any court summons whatsoever. My question is how are they allowed to fine me for exiting a restricted traffic zone a minute after I mistakenly entered it?  Do I have a case to sue them for all the stress that they have caused me?

You received a Penalty Charge Notice in the post.
You submitted a representation against this PCN and another related PCN (subsequently paid). You received a Notice of Rejection? Please post it up. Only redact your name and address.

When the deadline on the NoR payment window expired, you would have been sent a Charge Certificate. Did you get this?

When the Charge Cert payment window expired you would have been sent an Order for Recovery for Unpaid Penalty Charge, sealed by Northampton County Court. This would have included a Statutory Declaration form. Did you get the OfR?

When the payment window on the OfR expired you would have been sent a bailiff's Notice of Enforcement giving you seven clear days to pay and adding a £75 fee for the letter. Did you get this?
 

Do I have a case to sue them for all the stress that they have caused me?
