£160 PCN for 27 seconds - LEWISHAM COUNCIL

Hi
I dropped my elderly mother home who lives on a school road. I checked the time before I drove up it. It was 3.46pm. The road is penalty free at 3.45pm. Lewisham council say I drove up it at 3.44:33, They are charging me £160 for 27 seconds which not only do I believe their camera clock is out, but £160 for 27 seconds? My mothers a witness as she checked the time also and agreed it was 3.46pm when I went to entre the road. Please advise. I've logged an appeal and have written to my MP regarding.

Sorry, no good without some hard information, as you've not really told us anything useful at all for us to give good advice. So please read this and update your thread accordingly: -

The time discrepancy comes clearly under "de minimis", and would in all likelihood, win at an adjudication at London Tribunals (LT). There is no application of common sense in councils; or maybe there is, because councils refuse virtually ALL representations because they know that most people (>95%), then just cough-up to get the discount. Is this going to be you ?

If this were me, I'd be taking them to London Tribunals, but you have to risk the full PCN penalty; that's why people don't usually do it. However, to get to LT you must first submit reps to the council and get rejected; then you can register an appeal at LT

The penalty is £80 at discount. Let's see the PCN or if you can't post it what are the PCN number and car VRM.

In evidence terms, the video doesn't show the cars passing the restrictions sign.

Thank you. I didn’t notice that. It just shows the sign facing the bush on the left of the picture.
I also read somewhere that the sign does not show a clock at it so the driver can only reply on their own car clock as there is nothing to judge the time against.

Direction   cancel the Penalty Charge Notice and the Notice to Owner.
Reasons   
This PCN was issued for the alleged contravention of being stopped in a restricted area outside a school when prohibited. The alleged contravention occurred in Clovelly Avenue at 4.14pm on 8 March 2018.

I have looked at the CCTV footage and also the site images submitted by the Council. These show that Mr Byanouni's vehicle was stopped on entrance markings in front of Colindale Primary School. They also show that there is a sign at the location warning motorists that there is no stopping on the entrance markings between 2.45pm and 4.15pm Mondays to Fridays.

Mr Byanouni appeals because he says that he stopped to pick up his children from school. He says that he is well aware of the restrictions and that the clock in his car showed the time of 4.15pm. The Council says that its clock is calibrated according to the Atomic Clock, ensuring 100% accuracy. The CCTV timing shows the vehicle stopping at 4:14:18.

I accept the evidence of Mr Byanouni that the clock in his car showed the time of 4.15pm. I find that the alleged contravention did not occur. There must be some application of common sense. Motorists cannot all be expected to wear time pieces calibrated to the exact second according to the Atomic Clock. A motorist reading an ordinary watch will not be able to know the time calculated to the exact second.

Here’s a copy and paste of the first one. The second I added the information regarding the camera not picking up myself driving past the sign and the sign been faced the wrong way on the opposite side of the road towards the bush. I also highlighted the information regarding the gentleman‘s ruling when he picked up his child from school that’s above on these post.

I dropped my elderly mother home, who has health conditions ( including
mobility )who lives at Kilmorie Road. We waited until the time of
3.46pm, verified by both of our phones before I drove into the road and my
mother is witness to this. It appears your clock has incorrect timing on it.
However I'm somewhat surprized that a charge of £80 would be put forward
if your stating your clock is correct for 27 seconds. Please could could you
see it in your way to cancel this ticket. I'm a single mother on low income
and I was just supporting my mother to get home safe.
