Parkingeye, Overstayed, Birchanger Green- Bishops Stortford

Hi everyone,

I've received the attached notices as the keeper.

The driver entered the car park and took a nap, then left at the alleged time after going into the services and buying some breakfast.

Do note that as far as I'm aware, the attached letter is the first communication I've received regarding this.

What should I do in these circumstances?

Send a Subject Access Request to Parking Eye asking for all personal details they hold on you, which will include the original Notice to Keeper. This may be required in order to defend this properly.

No.
A Subject Access Request has nothing to do with parking tickets and appeals. Send it to their Data Protection Officer with supporting documentation of your identity. Look it up if this doesn't make sense. as just one example.

You appear to have a few days remaining in which to make an appeal - but on what basis? The argument will be that the driver read the signs and parked, entering into a contract, and is now being pursued for breach of contract on some basis, presumably because of a parking time limit. The registered keeper can be made liable under the Protection of Freedoms Act 2012 in place of the unknown driver, but that’s why the original notice may be important to see.

That said, I think you should direct your efforts first to the owner of the location to see if you can get them to cancel this for you.

I've now received the full list of correspondence including the initial PCN which I did not receive.







I've also had a response to the appeal that I made, saying I'd entered a Subject Access Request, and they're offering me the £60 'discounted' charge again for 14 days.

Do the good people of FTLA think it's worth paying that?

Parking Eye appear to have complied with the Protection of Freedoms Act 2012 to transfer liability from the driver to the registered keeper.
The driver entered into a contract by reading the signs and by parking.

That said, I think you should direct your efforts first to the owner of the location to see if you can get them to cancel this for you.

Owner of the location is clear that they won't get involved and all correspondence should be with ParkingEye.

I guess in this case the best course of action is to pay the discounted charge.
