LB Redbridge 01 Parked in a restricted street

Parked on a single yellow line in a restricted street, within the restricted time, at approximately 15:04. Penalty notice issued at 15:09. I was collecting and loading heavy items (shopping) into the car at the time and therefore needed to park closer to the store. 





I do not have the receipt of the shop however I may be able able to obtain one if I return with my loyalty card and they may be able to print a copy. The shop contained heavy items such as 3 large juices.

AI suggests a reasonably good chance and has created the following letter.

I contend that the PCN was issued incorrectly as my vehicle was exempt under the permitted activity of continuous loading and unloading of heavy and bulky goods.

At the time the ticket was issued, my vehicle was parked temporarily on the restriction to facilitate the loading of a heavy grocery shop. This included heavy bag and large, bulky containers of juice that were cumbersome and heavy to transport. Carrying these heavy goods from a distant, fully legal parking bay would have been entirely unreasonable.

Crucially, the loading activity was continuous and active, and there were no single or double yellow kerb markings (blips/stripes) indicating that a loading ban was in force at that location or during that time.

To support my claim, I have enclosed a screenshot of my {store name, e.g., supermarket} receipt timestamped at {Insert Time on Receipt}, which directly aligns with the time the enforcement officer logged my vehicle. This demonstrates that I was actively engaged in the transaction and transport of heavy goods to the car.

Given that the statutory exemption for loading heavy items applies and no loading restrictions were breached on the kerb, I kindly request that this Penalty Charge Notice be cancelled.

While the courts have not absolutely excluded 'shopping' from the definition of 'loading', this would succeed in exceptional circumstances only.

On the face of it, you do not qualify, you were simply shopping.

If such an activity qualified as loading then this would drive a coach and horses through the purpose of the restriction, see 7b.

Anyway, pl post your complete PCN(no need to redact anything), GSV location and all council photos pl.

There was one available spot and initially parked there. Genuinely tried to pay for one but the location was not showing in my RingGo app and was put off by calling the number and go through the list of options and possibly dial through a credit card (seemed too much hassle) for what was a 5-6 mins shop. So moved my car to the yellow line (which of course in hindsight was probably worse).

Shopping was not pre-paid.

OP, pl reinstate the hidden data, we can then look for the council's photos. What you've posted isn't conclusive i.e. we have no idea where the car was relative to the upright traffic and whether this had any effect whatsoever. Their photos and GSV will help.
