PCN Code 02 – Redbridge - Balfour rd – No loading Sign turned away from carriageway

Hi all,

Back with another one. Need assistance on a no loading zone.

The driver parked in the borough of Redbridge using a blue badge on double yellows. However it turned out to be a no loading zone but the driver was unaware as the no loading sign was turned around and not visible from the road.

Checking the PCN pictures, there were double blips on the kerb, but that was missed by the driver otherwise they would have parked elsewhere.

Is the sign being turned around enough to challenge the pcn? Looking for confirmation on the best angle for representations and whether Redbridge normally contests these when signage visibility is the issue.

The double yellow kerb blips - some look faded but will probably be seen as compliant by an adjudicator.

There is no requirement for a no loading sign where blips show no loading at any time. But that they have one is a point.

Traffic signs manual:

As the double kerb mark has only one meaning, authorities may decide that adequate guidance is given without “No loading at any time” upright signs or with fewer such signs. However, this could lead to enforcement difficulties, particularly as marks of this type usually need frequent maintenance.

It's always worth challenging as a BB driver.

Does this mean that this is then challengable?

From what you quoted from the TSM, my understanding is that because the upright sign was present but turned away from the carriageway, it means the authority did choose to rely on signage but it was presented incorrectly by being turned around and not visible from the road.

Ill be interested to see and may take a trip to have a look, since this PCN was issued nearly a week ago if the sign is still turned around.

Does it help that that little stretch of no loading lines are right next to disabled bays?

The double blips are immediately adjacent to the car and unmissable if the driver.

IMO, the driver does not have a statutory defence, so I'd be careful about suggesting that their reason for being in contravention is the council's fault!
