57 in a 50 (M1, variable limit gantry) - but WHO was driving???

Got letter re 57mph on M1 (southbound J15-J14) under a 50mph variable gantry.
Need to provide name of driver.

My husband and I were collecting our son from university that day, and we took turns driving.
We genuinely can't remember who was driving at that moment - and the supplied photos don't show faces.
What should we do???

What would you do if you wanted to work out who was driving?
What have you done so far to try to work out who was driving?

We have discussed the drive in detail but just can't work out which one of us it would have been.  We stopped for MacDonalds at a service station about an hour afterwards but we can't remember which one of us was driving there vs afterwards.  Son can't remember either :-/

If you do not know who was driving and cannot identify them after using reasonable diligence then you can take the matter to court and try and convince the bench you couldn't identify them.

It will be a nice day out.  But if you cannot convince the bench then it will be 6 points along with a corresponding fine and surcharge.  The CPS may ask for over £600 in costs if you progress to contested trial.

It's not easy, but can be done.

I am not qualified to give legal advice in the UK. While I will do my best to help you, you should not rely on my advice as if it was given by a lawyer qualified in the UK.

Imagine that if you named the driver you would get £1 million. Any idea now?
Maybe the carrot of costing up to £1000, 6 points and dearer insurance for the next 5 years will help as the £1m may not be on offer.
Bus driving since 1973. My advice, if you have a PSV licence, destroy it when you get to 65 or you'll be forever in demand.

Yeah, so apparently a memorable journey and you can remember stopping for a McDonalds an hour from the location but you would expect a court to consider that 3 adults cannot remember who was driving when you left your sons university digs?

If you are testing out your story it is extremely weak and I would expect one of you to come away with 6 points and an endorsement code that will considerably increase insurance premiums for 5 years.

The pragmatic way to deal with this is to provide the details of the one of you most likely to have been driving. If you cannot establish who was driving from the photographs, nor can anybody else.
