Hi i was wondering if it is possible to go to court to non guilty and ask the judge to throw one offence out and accept the other in order to lessen my sentence or conviction
To give context - one is driving without a license and the other is driving without insurance?
I am aware that it was not acceptable for both however i am looking a way to minimise my ban
Judges (or magistrates) do not “throw out” cases. They rule on those presented to them.
It is unlikely that the police will withdraw one of those charges. They have no reason to. You will see a fine and an endorsement imposed for each but will receive penalty points (or a ban) for the most serious. In the case of the two you mention that will be the one for no insurance.
If you are guilty of both offences and are looking to minimise the damage, a not guilty plea is not the way to go.
Was this in Tesco's carpark by any chance?
There is little point minimising the ban, if, as you are charged with, you do not have a licence, then you are not allowed to drive anyway.
If you have subsequently passed your test, then the 6 points for no insurance will see your new licence revoked until you resit your test.
