Speeding Fine

Hi

Looking for some advice

I was stopped by police check roadside for speeding 41 in a 30. They told me i would be sent on a speed awareness course
This was in February & i have been waiting for letter
Today i received a letter saying i have to pay £100 & 3pts or the option of going to court
There was no option for the awareness course
as i was advised
What is the best way to proceed with this
As i would prefer the original option of the course
Would be grateful for any advice

Have you done an awareness course in the last three years for the same kind of offence?  If so, you won't qualify.

The problem is most likely one of timing. Where things take a while (usually either a 3 or 4 month duration) a course may not be offered to prevent a timeout being engineered. The forces policy may well be on its website

A polite enquiry might just help if you haven't done a course in the last 3 years.

You have no absolute right to a course anyway. It's in the gift of the force.

At the roadside the officers won't have offereder a course (they would have no idea of eligibility anyway) however mant get the impression of ot from the language used.

Unfortunately, you have no right or entitlement to the course, they're offered as a gesture of goodwill from the police. You may enquire politely and they may reconsider but given the timing, they will likely not allow this as they'd want to avoid the offence becoming time-barred (6 months from the date of the offence the case needs to be laid with the courts). I'd also not delay in replying to the FPN as the closer it gets to the 6 months the more likely they are to just go to court wherein the punishment can increase.

The one time I've been pulled over for speeding, I was also informed by the officer that I would receive a letter through the post and I would probably be offered a course and this was stated despite being ineligible as my recorded speed was 43mph in a 30mph limit (1 mph over the 42 eligibility limit).

Some people suspect that at the roadside the police tend to minimise the likely outcome so as not to get involved in any lengthy discussion of the incident.
