Single Justice Procedure !
« on: July 22, 2024, 01:58:34 pm »
Can somebody PLEASE help or at least offer advice. I have been sent a letter by West Yorkshire Police stating that I had done 36mph in a 30mph zone, which I am  in agreement with and am OK to accept the points. However, they have informed me that I am to be charged with another offence, namely failing to give information regarding the identification of the driver. Meaning, they have insisted that a letter was sent out to me on 04/03/24 which I never received. Although I am 74 years of age the only thing that is still intact is my memory. I have been informed that if I plead not guilty to the latter I will have to go to court to plead my case which will undoubtedly involve paying court costs etc. As I have stated I am now 74 with no income to speak of and am panicking to say the least. I have only one week left to send this paperwork back to HMTCS. I would just like to add that if I had have received any correspondence regarding this matter before 11/7/24, then I would have supplied the details of my identification without a doubt as I would have no reason not to.

HELP!

Have you received a SJPN notice yet?

If so and if you have been dual charged with both the speeding and FtP offence the procedure recommended is to return a Not Guilty plea to both offences, and then you can 'do the deal' with the prosecutor to drop the FtP charge in return for a Guilty plea to the underlying speeding offence ... there is more detail to help you available on this forum, which you can search for.

There are no court costs of the type you are thinking of.

There are prosecution costs but unless it goes to trial they will stay at the amount it is indicated in what is presumably an SJPN they are asking for (£95?).

There are lots of ‘letters’ the police could send, most have a handy title on them to help, by the sound of it this is a single justice procedure notice?

There are motorists who have been scammed and those who are yet to be scammed!
