A30 (Plusha) Jct with B3257, Nr Lewannick - exceeding 50mph
« on: »
TO MODERATOR: So sorry for hijacking coffeepot's thread, I had no idea that was a thing as this is my first time on ANY forum. Won't happen again!

MY QUESTION:
My hubby got caught doing 67mph in that 50mph zone on the 22nd Jan and he felt that the advance warning for it dropping from 70 to 50 was very short and that because he was surrounded by other cars, it was too dangerous to suddenly brake once he realised.

He admitted to it being him and pointed out the above reasoning in an accompanying letter, but received the option of 3 penalty points and £100 fine or going to court to contest it. I see that @coffeepot (although admittedly going at a lower speed), got offered the course. My hubby has never had a driving infringement in 40 years of driving or had to do a course before, so I'm wondering if anyone has ever managed to somehow swap the 3 points for the course? It says on the Devon & Cornwall Police website that it's at the discretion of the police officer, so I'm not holding out much hope, but thought I'd ask as he is absolutely gutted to have blotted his driving record.

The guidelines for being offered a speed awareness course state that a course may be offered provided that the measured speed in a 50mph limit up to 64mph.

The police will consider the following grounds when assessing your eligibility for the driver awareness course:

your speed narrowly exceeded the limit and falls within the guidelines set out by the National Police Chief Council (NPCC) up to:
31 mph in a 20 mph area
42 mph in a 30 mph area
53 mph in a 40 mph area
64 mph in a 50 mph area
75 mph in a 60 mph area
86 mph in a 70 mph area
you haven’t already completed a course within three years or are booked on an upcoming course
As your husband was over this, I can't see a course being given.

Make sure he (or you on his behalf) submit his driving licence details as directed. This is required even though he has provided them when accepting he was the driver. If he does not he will face prosecution in court.
