Possible illegal NIP
« on: November 28, 2024, 04:03:04 pm »
Hi
I received a NIP through the post this morning. My question is can they prosecute under the following circumstances.
It was in a 30mph limit, just before a start of a 40 zone. It was 2 police officers with a camera on a tripod. They were in an unmarked vehicle, no uniform and no hi viz. No signs or anything, although I do know they are not mandatory. Also, the letter I received this morning did not have my recorded speed, which I thought was the norm, I'd kinda like to know what exactly I'm possibly being prosecuted for. It's my first offence so what is likley to be the outcome. If it's all legit and I did speed (I don't think I did but if it's legitimately proved otherwise) I will obviously put my hands up. Thanks in advance.

Yes
I am responsible for the accuracy of the information I post, not your ability to comprehend it.

if your letter says somewhere "S172" then it's asking for you to confirm the drivers details. you must do this or it will get a whole lot worse.

You comply with your obligation under s 172 to name the driver. Assuming that’s you, you’ll then be offered a speed awareness course, a fixed penalty or be sent a single justice procedure notice to have your case dealt with at court.

Surely the NIP says what the alleged offence is (e.g. exceeding the 30mph speed limit). It doesn't need to go into any detail of the recorded speed (though often it does).

The NIP has to inform you of "...the nature of the alleged offence and the time and place where it is alleged to have been committed"

The nature of the offence is exceeding he speed limit, so your NIP seems to fit the bill.
