Hiya,

I've moved a lot in the last few years due to personal issues but I have always kept my Driving licence address updated. I never knew the logbook had to be done too. (I will be doing it shortly after I post this)

My brother is currently living at one of my old addresses and today he hands me post from over a year ago he never passed onto me (I visit very rarely), inside the small pile is NIP from Surrey Police dated March 2024.

The date of offence and letter are within 4 days of each other

I have checked gov.uk for any penalty points, but there is nothing there.

To confirm, I am the registered owner and the offence location was somewhere I was passing going to work at the time, so I cant say it wasn't me.

This letter is dated over a year ago and it appears nothing has happened, can I ignore it? Should I still get in contact? This seems to be the only letter received.

On the face of it, an s. 172 requirement to name the driver was lawfully served on you, and you failed to provide the required information.

Proceedings for that offence were either instigated by issuing a Written Charge and Single Justice Procedure Notice within 6 months of the date of that offence (27 days after the notice was deemed served (2 working days after posting)). Or they weren't. Most likely the former.

If proceedings have been instigated, then if you have also been charged with the speeding offence, you might be able to do a deal with the prosecutor to drop the s. 172 charge in return for pleading guilty to the speeding offence.

If proceedings have not been instigated, then you should buy a lottery ticket.

There is no standard procedure for checking whether proceedings have been instigated in your name at an address you no longer live at and failed to update your V5C in respect of, other than to contact the relevant police department or court (if you know which court(s) s. 172 offences for Surrey are dealt with).

Thanks Andy,

I have just tried to access the offence via www.surreypas.co.uk (It was on the letter) and it is saying no record found.

I will try and call them tomorrow as I understand their lines are closed at the moment

Might also get that Lottery ticket...
