Speeding ticket from mobile speed camera

Hi everyone,

Posting this on behalf of my mum. She lives in Cardiff, South Wales. She was driving through Lake Road West (Roath) which I understand is among many roads in the area which have recently changed from 30mph to 20mph. She received a letter in the post saying she was caught doing 28mph on the 20mph road by a mobile speed camera van.

She has replied confirming she was the driver at the time and has now received a letter offering her £100 fine and 3 points or the option to appeal. She has never had points on her licence before but has completed a speed awareness course a number of years ago.

I'm just posting this here to see if there's anything we should be aware of or can be done in terms of an appeal, especially on the mobile speed camera front. If not, then I'll advise her to just go ahead and accept the £100 and 3 points if there's no other alternative.

  • How many years ago is a number of years? If more than three, a course ought to have been offered. But if they didn't there's probably little to be done to reverse that decision.
  • Does the option to appeal really say that? Normally you accept the fixed penalty or decline it, in which case it goes to court where there are options to mount a defence.

Apologies for not providing this detail earlier. I've checked with mum and her speed awareness course was February 2022, so yes it has been less than 3 years. I've also checked the letter again and you're correct, it's either the option of paying the fixed penalty or going to court.

We are not aware of any grounds in which she could defend herself in court, so I thought to check in with this forum first before advising her to accept the fixed penalty.

In response to Southpaw82 asking what I think can be done. The short answer is, I don't know. That's why I have asked the forum. This forum has been extremely helpful in assisting with getting a couple of parking charges cancelled in the past as it's brought to my attention various requirements that I wasn't aware of. Such as time limits, signage, etc.

I understand that speeding is very different from parking charges. I just wasn't aware of if there is anything particular we should be aware of in terms of requirements for mobile speed camera vans, or any specific requirements when a road has recently changed speed limit from 30mph to 20mph.

I wanted to check with this forum if there was anything obvious we should consider if we were to mount a defence. Forgive me if I am mistaken, but is that not the purpose of this forum? To share knowledge and experience on this topic?

I am clearly new to this forum, but I read all the important/sticky topics before posting. I provided as much information as I was led to believe was relevant. Any further information requested since my original post has been provided.
