SPEEDING FINE AND POINTS BUT IT WASN'T ME ?

I received this letter last year and I was quite baffled by it when I received it. I tried to contact somebody regarding this but no luck whatsoever. I didn’t hear anything more of it and I moved out of the address it was sent to a couple of months later and didn’t receive any letters while I was still there, until today a letter was posted at my mums address.I received a final steps letter regarding the attached (I only found this out as I called the courts number and found out that it was linked) they said the case was settled in April 2025 and I was found guilty for speeding and fined £1000 along with 6points. The car registration they read out over the phone I literally know nothing about and haven’t been to the area in my life. If I was aware of any court proceedings I would’ve annoyingly attended to prove my innocence. I have now filed an appeal and I will be waiting to hear back from them as someone’s clearly given false details. I’m wondering has anyone ever experienced this ? TIA

When you say that you have filed an appeal, what have you actually done?

N.B. We don't charge extra for white space.

I contacted the number on the letter and told them I wanted to dispute this, they then sent me a form to complete via email then I received a confirmation email. The start said ‘Thank you for your submission to ‘Options after a magistrates' court decision’. Your reference number is’

Again this person was pulled over by the police so there must be some sort of evidence I can view or something. I’m not to sure as this hasn’t happened to me before

The reason you have been asked to clarify what you mean by 'appeal' is that people often use this word without really understanding what it means.

Yes, now that you have a criminal conviction you can appeal to the Crown Court but from what you say that may not be the best way to proceed.  It may be something which is better handled by first making an application for the case to be re-opened in the Magistrate's Court.

It is therefore important that you set out exactly what you have done.

Hi,

Thanks for you input, you are correct. I have asked for them to re open the case so I can attend and prove my innocence. I was sent the evidence pack and police office said his body worn camera was on so this will show it wasn’t me driving. Thanks again everyone.

Yes, if it was kept at the time then 8 months from alleged offence to trial is nothing.
