NIP South Circular Road
« on: »
I have received the attached NIP. Location is on the South Circular Road A205 just to the east of the A23. I was travelling west and had just ridden back from a motorcycle tour to Germany. It was a long day and I either didn't realise that the speed limit on this section was 20 mph or just was not paying attention to my speed as I was clocked at 30 mph. Date of offence was 10 May, letter dated 15 May, received on 16 May so all within time it seems. Is there anything I can do to challenge this? Like other posters I cannot find the NIP Wizard on the site. Plenty of references to it but where is it?

I can't really think of anything.

The NIP seems to have been served in time from what you say. You don't seem to dispute that you were exceeding 20mph. That leaves really whether the limit is lawful and adequately signed.

You should be offered a course for that speed (if you have not done one for an offence that occurred in the three years prior to this one).

BTW, you may like to redact some of the information on your NIP, such as the reference number and passcode and your Reg. No.

The NIP Wizard was a feature of PePiPoo - which had been down on and off for some time before this site was created by some of the regulars, and now appears to be down for the forseeable.
It has never been a feature of this site.

Speeding is a strict liability offence. Nothing you have told us so far indicates a viable defence.
I am responsible for the accuracy of the information I post, not your ability to comprehend it.

OK thanks both for the advice. I rather doubted these was anything I could do on this one. I don't doubt I was doing 30 mph. I can't remember when the speed limit changed on this section of the South Circular but when there is no traffic jam it's a relatively fast road and hence easy to be caught out by a 20 mph limit. Ironically I used to do this section in the opposite direction taking my son to school from time to time (and then going on to work) and was quite aware of the positioning of the camera but I was not sufficiently alert coming in the opposite direction and having ridden all day from Germany.

I last did a Speed Awareness course probably 8-10 years ago so that's OK. I take it 30 mph in a 20 limit is close enough to qualify?

How do I redact a post already made? I cannot see an Edit button anywhere? I agree that having the Ref and Passcode out there isn't such a good idea. Or can a Moderator do this for me?

I was aware that NIP Wizard was a feature of Pepipoo and thought with the number of references to it on this site that it was here also but clearly not.

Here's a GSV ref to where I was nicked for what it's worth. The camera is clear enough.

Well, here's an interesting thing, I marched along the road using GSV in both directions. I could not find any speed limit signs until I came to this. Limit shown as 30 mph. Image is dated June 2023.

I will get the bike out and go and take a look now. If this is correct then the limit changed within the last 11 months. I could not recall it being 20 mph.

TfL is responsible for the A205. The stretch of that road to the east of the A23 is Christchurch Road and that seems to be (from your GSV) where you were caught. TfL introduced 20mph limits on Christchurch Road and Poynders Road (which is the stretch of the A205 to the west of the A23) in December 2023. I don't know whether there are any deficiencies in the legislation which provides for those stretches to be limited or whether the signage adequately conveys the limit to drivers.

It's a 20 limit OK. Christchurch Road east of A23. I cannot complain about lack of signage. Probably just a bit tired and didn't notice after a 400+ mile ride and only a couple of miles from home!

Just had the attached letter. Out of the blue but not complaining. Wonder what the administrative reasons were?

Out of interest, how far over the speed limit can you be and still get offered a Speed Awareness Course as an alternative to penalty points?

That's handy!   :)

Courses are normally offered up to (Limit+10%+9mph).

So up to 31 mph in a 20 mph limit. I would have qualified if I had not been let off.

Why don't you ask them if you can do one anyway!   ;D
