NIP for speeding

Received a Notice of Intended prosecution, driving 42 in 20 mph zone.

Any advice? Just to fill a form and await?

That will eventually go to court (it cannot be deal with by fixed penalty/course) and you are looking at a ban of a matter of weeks.

Along with an income-related fine, surcharge (40% of that fine) and costs.

Thank you JustLoveCars. Are there any mitigating factors that i can use? I dont have any points on my license.

The guidelines for 41 and above are a short ban (7 to 56 days), or 6 points. The offence is at the very bottom of the range, so 6 points would seem likely.

There is very little that can be said in mitigation, and we can't conjure up reasons from thin air - have you any suggestions? It's very easy to offer something which actually makes matter worse.

Never been to any courts or had any points so feeling anxious. They recently changed that road from 30 to 20 and my fault for forgetting about that.

Unless you indicate that you want to attend court and provided you plead guilty, your case will initially be heard under the “Single Justice” (SJ) procedure at a hearing which you cannot attend.

If the SJ believes that points are appropriate you will be sentenced by that court and informed of the outcome by post. Only if the SJ believes that a ban should be considered will your case be adjourned to a  hearing in the normal Magistrates’ Court and you will be asked to attend.

As above, six points is the most likely outcome.

Also, your fault for forgetting that 42mph is considerably in excess of 30mph and would have seen enforcement as well.

Completely agree with you that 42 was way too much, my fault entirely.
