NIP for 47 in 30, hope for FPN realistic?
« on: »
A38 Saltash tunnel, no points in license no speeding history or any other police involvement. I understand course is not an option as my speed exceeded the 1.1x30 + 9= 42mph, hence the best outcome I can hope for is the FPN for £100 penalty and my first 3 points. Can the forum gurus please advise if this hope is realistic or if the above details should result in court summons and criminal conviction?

Yes it is realistic. You should be offered a fixed penalty for that speed.

And read the instructions on the COFP. All of them.

Many thanks to all posters for the clear estimates; certainly I see people often assume they only need to send license details in NIP stage, ignoring resending them on FPN acceptance, resulting in an SJPN.

From my personal investigation on what happened: the integrated GPS of the hire car I was driving, otherwise very accurate, was showing a 50mph limit within the tunnel, possibly a default state after losing signal underground. Regarding road signage, the 30mph limit is not listed within the tunnel, and with my westbound direction of travel having two lanes and being nearly empty, I trusted my car’s GPS and targeted 45mph with the results we discussed.

While responding to the NIP, do you think it worthwhile to draft a polite covering letter explaining the above, highlighting the fact that this is not an excuse or blame on road signage, but my personal analysis of the incident resulting in an already adopted driving and lessons integrated?

From experience, pointless. Don't waste the ink.

Nope, it's not because it appears to be a restricted road.  The terminal signs seem really clear in both directions Here or Here.

Although unlikely, they may take any such letter as a 'defence' and not issue a CoFP.  At court that excess would be 5 or 6 points and a lot more than £100.

Always rely on the Mk 1 eyeball and not GPS.
