Author Topic: Incorrect Endorsement information on my Driving licence - Advice.  (Read 486 times)

I checked my DVLA online driving licence record today and noticed that there had been a CD10 Careless driving and AC10 failing to stop added from an offence May last year and a conviction for this in January this year. Totalling 7 points and a £245 fine.

I know nothing about these, and the court listed is nowhere near me or anywhere that I went on the day they are saying the offence took place.

Ive not had any court documents nor have any idea why these are here on my record, but now it makes sense why my insurance quotes are so large.

Ive obviously not stated that i have any endorsements so am now concerned about my insurance situation, and how to go about getting this rectified.

The only advise i got was that this was either an error with the dvla or the court, and i will contact the court on Monday, but has anyone any experience with this situation?

Just to add, I have not been involved in any accident, nor been contacted by the police or have any knowledge of the above. I drive about 5 miles a day around local roads and the court involved is the other side of the country. I have Google timeline proof and more that I was at home working most of the day and of any movements.

Until you have found out what happened regarding the court and the DVLA, there's not much we can help with.

*If* "you" were convicted without being made aware of the court proceedings then you have 21 days from becoming aware of the proceedings to make a statutory declaration under s. 14 Magistrates' Courts Act 1980 (chances of getting an appointment within that timescale are slim, but for all practical purposes, you would need to make an appointment within the 21 days).

If "you" were not convicted of anything, then it would be a matter of getting the DVLA to fix it (or getting the court to get the DVLA to fix it if it was their error).

N.B. It seems likely (but by no means certain), that somebody with the same name as you was convicted of the offences. Whether it was someone with the same name, someone who gave a false name, or whatever is a whole other rabbit hole to run into only if necessary.

Thank you for the swift reply.

I will find out what I can by contacting the court on Monday, hopefully they will give me information over the phone so it can be resolved quickly.

I have sent an enquiry to the DVLA as well.

I will post back once I know more.

The DVLA were useless and responded that they would only update the details on the instructions of the court which supplied the information, and wouldn't even check if they had made a mistake, although at least they responded quickly.

I contacted the court, and the first person said simply that I needed to file a stat dec however the person who did attend court for this pleaded guilty so that might be difficult, however I did speak to someone who noted that although they have the same DOB and name as me, the address they have wasn't the same as mine. They wouldn't give me anything else but said that I should have a response from them within a few days.

This hasn't happened, so I rang them again today and they advised I email the court directly with the information again, and also contact the police central ticket office to see what they could do.

They advised to contact Action Fraud, which i did and filled out a report, but very quickly got a reply to say that they don't see this as a crime and I still don't know if they are doing anything about it, so i'm left in limbo hoping that the court will respond soon as thats my last and only avenue to resolve this.

Might also be an idea to email the DVLA's data protection officer, you have a right to rectification of inaccurate data. They may be able to kick the right people up the bum to get this corrected (or check themselves).

I would include the information you already know, including that you have asked the court and they have confirmed this person has the same name and DOB, but a different address.

Finally got an update, the court have just rung and said that the information they have is correct, and that it isn't me. The person involved has the same name and DOB as me but has a different driver number and address. They have sent the correct information to the DVLA and the DVLA have made the mistake, so they are going to contact the DVLA on my behalf. Apparently it should take around 10 days to reflect on my driver record. The person at the court was very professional and helpful.

Thank you everyone for your advice. Hopefully this is resolved soon.

Once your driver record has been corrected, don't forget to inform your motor insurance company to see if they had accessed your licence details before quoting you and if so, see about getting a refund for the extra premium paid.
