Hi, I need some advice on a speeding allegation.
« on: »
I was driving on a 50 mph limit road. A police officer entered from a roundabout while i was two cars ahead.

Officer initially alleged a speed of 83 mph as that’s what it took to make ground on me. Upon denying this speed, officer verbally reduced the allegation to approximately 70–73 mph. Officer stated he did not have a laser or radar, but claimed he was travelling at 83 mph and “wasn’t gaining much ground,” using this to estimate my speed which he has recording of via dashcam.

I’m not here to deny, as I hold my hand up I was going at 62-65 mph maximum, of course when questioned i said i was going 50mph. The road was 1.1km in length, in which I braked to exit around 800m in. I have an electric car which accelerates fast, which could create speed differential. Officer stated he would review footage and finalise the speed later, so the exact alleged speed is not yet confirmed but he cautioned me and told me to expect a letter, and if i have any arguement he will see me in court.

First time offence, clean license. Any advice appreciated regarding any defences or next steps i should prepare for. Thank you for your time

This is currently bordering on a "have I been caught?" thread. The occifer will submit his report and either you will get something through the post or you won't.

It is possible that your speed can be determined from the footage from his dashcam - whether anyone will bother is another matter.

Unless there is any relevant evidence that you can obtain and preserve at this point, not much you can do. That said, whenever anything might end up in court, make contemporaneous notes of anything that might realistically be relevant.

Thanks for your reply, Andy. It was not the intention to be "have I been caught", as i am well aware that i have been caught, but not accurate to the speed i was going. If charged, theres a pretty big difference between 80mph - 65.

Moreover, it has more of the intention to ask whether a police officer's dashcam of them "going 80mph" to gain ground can be used as valid evidence, and/or, would there be any mitigating circumstances if I am charged with 80mph, as he admitted he didn't know the exact speed i was going and reduced it when challenged. Seems procedurally unfair in all honesty. The reason I ask is because i am documenting all notes and ideas now.

Up to and including 64mph you might be offered a course. Above that, up to and including 75mph should see a fixed penalty (£100 and three points) offered. Above that and it will be court.

That's the point - *if* charged.
Yes, you have been "caught". However, this case appears to still be mostly hypothetical - will anything come of it, and if so, what evidence will be presented and what weight will it carry?
