UKPC parking ticket for parking on private land whilst doing delivery

on the 30th of september the driver received a parking ticket for parking in a road way on the 26th of september whilst delivering parcels.

The driver was delivering for amazon fresh and the location was in a high story apartment & consisted of a lot of parcels which required a trolley.

If anyone could help with the appeal this would be great, i do also have an image of the NTK they sent me but im unsure on how to post it.

The road was Nine elms park, moat lane.

Have you a copy of the images of the signs in order to provide further assistance.Parked in roadway seems quite vague I would have thought they would have a delivery area.

I’ve just checked on google maps & there’s only bays for electric vehicles & disabled badge holders only and at the time of the delivery, the bays were all taken.

the signs are pretty blurry but that’s the best screenshot i can take of them. and the blue badge holders is the exact same as these. however you can maybe find a clearer photo if you search online but im not sure if this would help.

You are right the pictures of the signs are blurry so it is difficult to make out the terms and conditions. No parking sign is there it depends on how clear it was to the driver who had supposedly a valid reason to park to unload. Although yellow lines are not legally required on private roads they are used on many occasions to reinforce the T&Cs. The registered keeper needs to submit an appeal on possible lack of signs if appropriate.

do you think the driver would win the appeal by mentioning the lack of signs? and if so are you able to maybe structure an appeal message for the driver.

Lack of signage is very important in any appeal. At present I have an engagement that needs my prescence but if you put lack of signage into the search engine this will no doubt provide you with some guidance otherwise you may have to wait until at tomorrow.

 An entrance sign must be displayed and maintained at the entrance to the controlled land to inform drivers  as appropriate whether parking is permitted subject to terms and conditions including payment or is prohibited unless
 
The nature of the premises makes this unnecessary such that drivers would  not reasonably assume parking was permissible gives an example of a small shop forecourt or private driveway.
As one can see there are no signs at all at the entrance of the Industrial/ Retail Park on one of the two entrances.The one that does have one states P Welcome in blue on the offside of the road when driving into the estate this sign is not conspicuous and is placed on the side of the road where there are yellow lines.
The other sub section relates to where signs are not practicable e.g where local planning restrictions prohibit such signs.

I feel that as the driver entered the estate at an entrance where no signs were displayed this needs to be considered.

Further subsection 3.1.3 states that signs placed on the controlled land drivers have the chance to read them at the time of parking or leaving the vehicle it adds that the signs must be clearly visible to the driver from a distance and legible on approach.
Given the fact that the signs were placed on the ground behind parking bays whereby they are obstructed to the view of a driver when a vehicle is parked in a parking bay where they are sited this in itself must hold credence.
These signs could have been placed strategically on the building alongside the signs indicating that customers only should park in the parking bays. It Would make sense to have the relative signs places at every parking bay.
Now this is just an example that you need to to formulate the appeal it needs to be tailored to the particular circumstances
