Hello everyone. I got another parking ticket from another private operator, UKPC. I was parked on a bay on Sunbeam Road, which is a private road. Apparently, this bay is for registered users only and I was parked here for 14 minutes and 5 seconds.

I was parked here as I was doing a delivery for a company called Ateliers London to pick up a sofa. I was given an incorrect address of 17 - 21 sunbeam road which is why I was parked there for so long as I couldn't find the company. The actual address is on the same road but slightly further up (the building at the end with the white triangular roof).

Will I still be able to appeal with my original delivery notes? I understand this is a private company so I assume they will reject my appeals regardless of any loading notes. Any help would be appreciated.

Please confirm that no Notice to Driver (NtD) was affixed to the vehicle.

The Notice to Keeper (NtK) is not fully compliant with all the requirements of PoFA to be able to hold the known Keeper of the vehicle liable for the charge. The unknown (to UKPC) driver is always liable but, as there is no legal obligation on the known Keeper to identify the unknown driver, you should decline to do so.

What evidence have they provided to show that the vehicle was actually parked for 14 minutes? The NtK does not specify a period of parking as required under PoFA paragraph 9(2)(a). There are other failures but this is the most significant one.

One other anomaly, if this was an NtK issued under paragraph 9 of PoFA, is how they managed to obtain the Keepers data from the DVLA on the same day as the alleged contravention. A KADOE request can only be processed no less than overnight. The NtK says that the alleged contravention occurred on 23/04/2025 and that the notice was issued on the same date.

You have until Friday 23rd May to appeal and I suggest that you do so with the following, ONLY as the Keeper. Any reference to the driver must be n the third person. No "I did this or that", only " the driver did this or that":

I am the keeper of the vehicle and I dispute your 'parking charge'. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

As your Notice to Keeper (NtK) does not fully comply with ALL the requirements of PoFA 2012, you are unable to hold the keeper of the vehicle liable for the charge. Partial or even substantial compliance is not sufficient. There will be no admission as to who was driving and no inference or assumptions can be drawn. UKPC has relied on contract law allegations of breach against the driver only.

The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NtK can only hold the driver liable. UKPC have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

This will be rejected, as would any appeal, no matter what was pleaded. However, it will get you a POPLA code which we can deal with later.

The DVLA does not allow real-time access to registered keeper data. It is simply not possible for them to have:

• Identified the vehicle
• Applied for and received keeper data from the DVLA
• Processed the information
• Printed and issued the NtK,

all on the same day as the alleged contravention.

For the "Tell us what specific information you need about your vehicles" section put the following:

I am requesting specific information about a KADOE request made by UK Parking Control Ltd (UKPC), a BPA Approved Operator, regarding my vehicle.

The alleged parking contravention occurred on 23 April 2025 at 13:20, and the Notice to Keeper (NtK) I received is dated the same day: 23 April 2025. The NtK states that UKPC had "checked the vehicle details with the DVLA" before issuing the notice.

This raises a serious concern because, under the KADOE contract and BPA rules, private parking companies are not permitted real-time access to DVLA data. It should not be technically possible for a parking company to:

• submit a KADOE request,
• receive a response from the DVLA,
• process the data,
• and issue a postal Notice to Keeper,

all on the same day as the alleged event.

I therefore request the following information:

1. The exact date and time UKPC submitted the KADOE request for my data in relation to this event.
2. The exact date and time the DVLA responded to that request and released my keeper data.
3. The method by which the request was made (e.g., electronic interface, manual, batch, etc.).
4. A copy of the request and response logs (with redactions if required).

This request is made under the Data Protection Act 2018 and is necessary to verify the lawfulness and timeline of personal data processing by UKPC.

OK I see. Thank you for the advice. I will appeal this right away. Not surprised they will reject it but I will be expecting it nevertheless. I never thought about how they managed to find out that my vehicle was parked for 14 minutes so now I will keep that in mind.

They have already sent me a final reminder through the post today. I only received the PCN through the post roughly 2 weeks ago

Correct.
It’s a common tactic trying to get you to name the driver, next will come a rejection “after careful consideration” and a POPLA code.
