Firstly thanks for everything you do here. You dont need to do it but you do, so thank you.
Upon entering the car park, the driver found a space, parked up, and proceeded to attend to an emergency related to a baby. Driver unable to pay the £1 fee due to an unreliable internet connection. On 16th Oct, I, the registered keeper, received a PCN through the post”
Anything else you'd like me to add?
TIA
Hope this works:

Thanks, am I likely to be successful if I cant provide any evidence? If they have cctv it will corroborate my emergency but I dont have access to that. There's no box to enter any detail, its just a drop down list and an option to attach a file.
On initial appeal, almost certainly not. Does the baby has a pre-existing condition related to the 'emergency'? There is no CCTV.
IAS almost certainly will not accept any appeal. The way this will be dealt with is through a county court claim which you will successfully defend and they will discontinue before they are required to pay the £27 trial fee.
Thanks again for replying. The baby does, but nothing documented with a GP, only with Nursery. Should I not bother appealing then? What action/inaction should I take and what can I expect to happen here please around this county court claim?
Thanks so much for your time.
If the IAS does not uphold the appeal, (highly unlikely), then it will eventually progress to a county court claim which will be issued by DCB Legal. I can tell you with over 99.9% certainty that any claim issued by DCB Legal, as long as it is defended, will either be struck out or discontinued.
They rely on useless debt recovery letters and the threat of litigation to intimidate the low-hanging fruit on the gullible tree into paying out of ignorance and fear.
So grateful for your help, sincerely! Im curious to see how this unfolds...
Should I appeal on annex F to SMARTPARKING or just ignore entirely? When you say "as long as its defended", what do I need to do there?
Thanks.
As (not so) Smart Parking are nothing but a firm of ex-clampers, they will never accept an initial appeal. Also, the IAS, is nothing but a kangaroo court. If neither appeal is successful, this will go all the way to a county court claim. As long as the claim is defended, using the defence template we provide, it will either be struck out or discontinued.
Thank you, any chance you could link me to the defence template please? I need to read up on my defence and understand what I need to do/prepare.
You do not need it right now but you are free to use the forum search function and look for any of the countless claims that have been defended using this.
Ta, sorry for being thick. So i need to appeal to smartparking first then the IAS. Just wondering which of the 20 or so appeal options I should choose. Assuming "there was an emergency on site". Thanks again.
When appealing to smartparking, what selection would you choose from their drop down? Would it be "emergency", "other", "not the driver" etc?
You are appealing as the registered keeper. DO NOT identify who was driving. There is no legal obligation on the keeper to identify the driver. If you are the Keeper and were driving, you DO NOT blab that you were also the driver. you simply refer to the the driver in the third person. No "I did this or that", only "the driver did this or that".
As for the drivers reason, I'll leave that up to you. It is your appeal for the reasons you claim.
