Last week i got a call to say i had a sherrif court letter which is a Simple procedure claim from PFS for euro car parks.

I then got a Demand for payment before court action from pollock fairbridge schiavone when i collected
saying i must pay within 7 days or face court procedings

As a forum, we are not familiar with Scottish law, primarily because - unlike in England and Wales - the liability for private parking invoices can not be transferred from the (usually unknown) driver to the registered keeper, because
An Act to provide for the destruction, retention, use and other regulation of certain evidential material; to impose consent and other requirements in relation to certain processing of biometric in...
legislation.gov.uk
does not apply in Scotland.

For single instances the advice is usually to ignore debt collectors and let them do their worst.

Your problem may be that they’re tempted to try something for 19 tickets.

There are a few examples if you search the forum, but not very much. See https://www.ftla.uk/private-parking-tickets/scotland-solicitor-letter-threatening-sheriff-court-for-pcn/msg96214/#msg96214, for example. Note that this one particular case eventually led to the claimant backing down, but not immediately.

Has the driver been identified to anyone during the process? Can you post at least one of the PCNs?

I do not know if there is anyone who can provide more detailed advice. I know I can’t. Sorry.

Subject Access Request can be used to obtain all personal information held on you, including PCNs, and this legislation is applicable in Scotland. From Euro Car Parks. Asking as the registered keeper, ensuring not to identify the driver.

You need to know on what basis you’re being asked for money.

Update your car’s V5C if it’s wrong and you haven’t done so already.

Post up the court notice you have received.  The thread jfollows linked is the only one I can recall on here where a Parking Co tried court in Scotland.  If you were not the driver then you appear to have a straight forward defence that you have no liability since you weren't driving and there is no keeper liability in Scotland (yet!). They may well try and push this all the way to hearing however, given the sum involved, and they like a precedent to threaten other people with!  What ever you do don't ignore it as that may well result in a default judgement against you.

It's a priority in this matter to ensure that all parties now have the correct address for correspondence.

You do not want to 'miss' any more letters etc.

This is, in theory, easy to defend.
