I, the registered keeper received this Fixed Charge Notice for the vehicle overstaying in their car park one evening. A ticket was paid for physically and left on the dashboard, however it appears it did not cover the entirety of the stay which their ANPR has identified and generated this FCN.

Photos of the signage taken this week, allegedly the lighting was not functional on the date in question, however I have no proof of this (so bit of a moot statement).

You've left the PCN number showing.  Also, posters are asked not to eat sparce resources by uploading files here.  Please delete the uploads, delete the PCN reference, upload to an external hosting site like www.imgur.com and post the links.

Having said all that, the warning notice doesn't strictly comply with the requirements of paragraph 9(2(f) of Schedule 4 to the Protection of Freedoms Act 2012 ("POFA") so even if the driver (who should not be identified) is liable, there's a good argument that the keeper isn't liable.  This is not, however, an argument that Napier will accept and I don't think the kangaroo court known as IAS will accept it either.  Fortunately, IAS decisions are not binding on motorists so the only way Napier can enforce the ticket is by suing you in the County Court and winning the case.  There's guidance over on https://forums.moneysavingexpert.com/discussion/4816822/newbies-private-parking-ticket-old-or-new-read-these-faqs-first-thankyou/p1 about how to beat them if they sue you.

You basically have a choice; pay now for a quiet life or settle down to months if not years of incoming paperwork followed (with plenty of hard work by you) by probable victory in the end.

If you decide to go for the long game you must notify Napier of your new address each time you move to avoid getting a CCJ because if the court papers go to your old address you might not see them in time.

Hi, I did read the rules and uploaded all the image to IMGUR to begin with, the images were being hot loaded from imgur.com not ftla.uk as far as I can see? In either cae, I've changed the linking to a direct URL instead just incase.

I thought that may well be the case, as always, often just less aggro to pay up.
