You can overthink this and screw it up or you can accept a bet from me at 100:1 odds that this defence will lead to either a strike out or a discontinuation.

This defence was written by a very long serving district judge and is based all DCB Legal issued claims. It has never failed yet.

“NO VALID PERMIT DISPLAYED” does NOT adequately set out the reason why the contract was breached.

“Arnold Street Leicester” does not describe the location with sufficient particularity. What address exactly on Arnold Street?

Regarding the interest calculated, from what date was the interest calculated? On what amount has the interest been calculated? The claim is for £179.92 but the original charge is only £100. What is the extra £79.92? How has it been calculated? If it includes a debt recovery fee, has VAT been charged on it? If not, why not? Is it ‘damages’? If so, on what basis have these ‘damages’ been calculated?

Are you being pursued as the Driver or the Keeper? What specificity has the claimant said is the reason for an alternative pleading? They cannot just plead alternatives otherwise every claim could just list a load of reasons in a some kind of scattergun approach. If they have no evidence that the defendant is the driver, the they can ONLY sue on the basis that they are the Keeper and the claimant has fully complied with PoFA. If they are suing the defendant as the driver, then they cannot rely on PoFA and must be put to strict proof.

Anyway, you can follow the advice and guarantee that the claim will never get as far as a hearing of you can try your own way.

Thank you so much for such detailed clarification and please excuse my legal ignorance!
I will submit the defence in a couple of days at the latest and will post here once I hear anything back from them.

As I mentioned above that I responded to their letter of claim asking for proof of their claim.I have today received this below email from DCB LEGAL.I am assuming it doesn't require a response.


We write in response to your correspondence received in our office dated 11/08/2025.

We now respond to the same as follows.

Our Client will ensure that there are signs clearly displayed on the land, outlining the terms of the parking. These will generally be displayed at the entrance and exit of the land/ car park, as well as being positioned at various points throughout the land (Please refer to the attached Site Plan) Our Client does not need to prove that you read and understood the terms of those signs and will rely on the fact that the signs were situated on the land and that a reasonable person would have seen them. You should always be vigilant when entering any land that you are not familiar with or that you know is privately owned and there are parking terms in place.

If there are any documents that you have requested, but that are not attached, it is because we have deemed the request to be disproportionate and/or not relevant to the substantive issues in dispute. We respectfully draw your attention to paragraph 2.1(c) of the Protocol and remind you that both parties are expected to act reasonably and proportionately.

Please note, a claim was accepted against you on 28/08/2025. Please either address the Cout documentation or make payment of the claim amount of £264.72 within the relevant time frame. Failure to do so will result in Judgment being requested against you in default. If accepted a County Court Judgment will be placed on your credit file.

It’s really not worth the effort to respond to intellectually malnourished wannabe legals such as Sofia Marth and all the other incompetents at DCB
Legal. You could report them to the SRA for failing to comply with the PAPDC and you could make a counterclaim using the cases described in the response to their LoC.

I am on vacation right now so will not be expending much effort on this. You have submitted the defence. Follow the advice as given in all other DCB
Legal issued claims and this will also be either struck out or discontinued.

Hello again..I received a copy of their N180 in the email on 29SEP 25 and after reading a few previous cases I wanted to ask if there is anything we should object to.
In response to E1 they just put TBC and under the signature at the last page they just wrote DCB LEGAL LTD.

I also received my own N180 in post on 13th Oct 25 and will follow the advice on previous cases.

I write as the Defendant in the above claim. I copy this to the Civil National Business Centre for transparency.
The Claimant’s N180 (version 11/24) is defective:

• Section E1 (“name and contact details of the person who will attend the mediation”) is completed “TBC”, which does not provide the details required for the Small Claims Mediation Service to schedule an appointment.
• The N180 is “signed” only “DCB Legal Ltd”. Under PD 5A §2.1, documents drafted by a legal representative must bear the individual’s signature and state their capacity and firm. CPR 5.3 permits mechanical signatures, but still of a person, not merely a firm. A firm name alone does not identify a signatory.

Please file and serve a corrected N180 within 7 days, providing the E1 attendee’s name and contact details and bearing the name/signature of an individual legal representative with their capacity stated.

Failing that, I will invite the Court to (a) disregard the Claimant’s mediation response pending compliance, and (b) direct the Claimant to file and serve a properly completed N180 within 7 days, failing which it be treated as not filed.

Do I have to wait for their response of this before submitting my own N180 ? The date on my N180 form says you must submit by 30th October 2025.

Hello, My case was transferred to the court in January and haven't heard anything yet.I will update the outcome once I hear anything back.
In the meantime I have received another parking charge which was from 2022.The particulars of claim are all same as this one apart from the Reason.The ongoing case's reason was "No valid permit" and the one I have received now has reason "Vehicle remained on private property in breach of the displayed T&Cs".
Should I follow the same process I followed in my ongoing case with your defence or has anything changed in the last 4 months and I need to start a new thread here for guidance ?

No its a different claimant at a different location but the solicitors are the same DCB Legal.
What I meant to ask was that if its still the same process to proceed for me with the new case just as I followed your guide in the current case then I can simply copy and paste that from my current case, like the 122 line defence and following questionnaire without adding that extra workload for you guys to spend time and effort.
